2621 10 — Ash and residues from the incineration of municipal waste

Ash and residues from the incineration of municipal waste

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Machine translation. The original is the Russian text of the EAEU tariff, and customs goes by it; this translation is for understanding only and has no legal force.

2621 Other slag and ash, including ash from seaweed (kelp); ash and residues from municipal waste incineration: 2621 10 – ash and residues from municipal waste incineration 2621 90 – other

This heading covers slag and ash not falling under headings 2618, 2619 or 2620, obtained from ore treatment or metallurgical processes, and slag and ash obtained from any other material or from other processes. Although many of the products are used as fertilizers, they are included here and not in Chapter 31 (except for basic slag). Such products include: (1) Mineral ash and clinker, which are obtained mainly by burning coal, lignite, peat or oil in utilitarian boilers. They are mainly used as raw materials in the production of cement, additives to cement in concrete, in tamponage material from quacks, as a mineral filler in the production of plastics and paints, light filler in the production of building blocks and in civil structures such as dams, inclined entrances of highways and bridge supports. These include: (a) ash dust - finely dispersed particles carried by flue gases and removed from the gas stream by bag or electrostatic filters; (b) ash residue - coarser ash removed from the gas immediately after it leaves the furnace; (c) furnace slag - coarse residues removed from the furnace bottom; (d) ash when burning coal in a fluidized layer - inorganic sludge from burning coal or oil in a furnace with a fluidized layer of lime or dolomite. (2) Kelp and other plant ash. Kelp of this heading is material obtained by the insulation of certain types of seaweed. In the raw state, it is a heavy rough blackish substance, but after cleaning it is a matte white powder. It is mainly used to extract yo da or in the glass industry. This group also includes rice husk ash composed almost entirely of silica and used mainly for the manufacture of sound-proofing bricks or other sound-proofing products. (3) Bone ash obtained as a result of bone calcination in the open air. In addition to fertilizers for the soil, this product is also used to coat the moulds when melting copper. This heading does not include animal coal produced by the calcination of bones in an autoclave (heading 3802). (4) Raw potash salt obtained in the sugar industry from residues of black molasses by calcination, washing, etc. (5) Ash and residues obtained from the incineration of municipal waste (see note 4 to chapter 38). Such ash and residues are often a mixture of clinker and some amount of toxic metals (for example, lead) and are used mainly in the construction of temporary road surfaces on mounds as a filler. The content of metals in this type of ash and residues is insufficient for the extraction of metals or metal compounds.

This heading does not cover chemically defined microsilicon produced as a by-product of silicon, ferrosilicon and zirconium, used principally as a pozzolan additive in concrete, fibrocement or refractory concrete, and as an additive in polymers (heading 2811).

Notes to chapter 26 — Ores, slag and ash 5 items

Notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. This chapter does not cover:

(a) slag or similar industrial waste prepared as macadam (heading 2517);

(b) natural magnesium carbonate (magnesite), whether or not calcined (heading 2519);

(c) sludges from the storage tanks of petroleum oils, consisting mainly of such oils (heading 2710);

(d) basic slag of Chapter 31;

(e) slag wool, rock wool or similar mineral wools (heading 6806);

(f) waste or scrap of precious metal or of metal clad with precious metal; other waste or scrap containing precious metal or precious-metal compounds, of a kind used principally for the recovery of precious metal (heading 7112 or 8549); or

(g) copper, nickel or cobalt mattes produced by any process of smelting (Section XV).

2. For the purposes of headings 2601 to 2617, the term ‘ores’ means minerals of mineralogical species actually used in the metallurgical industry for the extraction of mercury, of the metals of heading 2844 or of the metals of Section XIV or XV, even if they are intended for non-metallurgical purposes. Headings 2601 to 2617 do not, however, include minerals which have been submitted to processes not normal to the metallurgical industry.

3. Heading 2620 applies only to:

(a) slag, ash and residues of a kind used in industry either for the extraction of metals or as a basis for the manufacture of chemical compounds of metals, excluding ash and residues from the incineration of municipal waste (heading 2621); and

(b) slag, ash and residues containing arsenic, whether or not containing metals, of a kind used either for the extraction of arsenic or metals or for the manufacture of their chemical compounds.

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheading 2620 21, ‘leaded gasoline sludges and leaded anti-knock compound sludges’ mean sludges obtained from storage tanks of leaded gasoline and leaded anti-knock compounds (for example, tetraethyl lead), and consisting essentially of lead, lead compounds and iron oxide.

2. Slag, ash and residues containing arsenic, mercury, thallium or their mixtures, of a kind used for the extraction of arsenic or those metals or for the manufacture of their chemical compounds, are to be classified in subheading 2620 60.
