3101 Fertilizers of animal or plant origin, mixed or unmixed, chemically processed or untreated; fertilizers obtained by mixing or chemically treating products of plant or animal origin

This heading includes:

(a) animal or vegetable fertilisers, whether or not mixed together or chemically treated; (b) products of vegetable or animal origin converted into fertilisers by mixing or chemical treatment (other than bone superphosphates of heading 3103). However, these products fall in heading 3105 if put up in the forms or packings provided for in that heading. The heading includes, inter alia: (1) Guano, which consists of the excrement and remains of sea birds found in large quantities on certain islands and sea coasts. It contains nitrogen and phosphorus and is usually a yellowish powder with a strong ammoniacal odour. (2) Excrement, contaminated wool waste and manure, unfit for any use other than as fertilisers. (3) Decayed vegetable products unfit for any use other than as fertilisers. (4) Ground guano. (5) Products obtained as waste from the treatment of leather with sulphuric acid. (6) Compost, consisting of decayed vegetable waste and other matter, the decomposition of which has been accelerated or controlled by treatment with lime, etc. (7) Residues and waste from wool scouring. (8) Mixtures of dried blood and bone meal. (9) Stabilised sewage sludge from municipal sewage treatment plants. Stabilised sewage sludge is obtained by fractionating sewage sludge to remove large objects and to settle out sand and heavy non-biological constituents; the remaining sludge is then air-dried or filtered. The stabilised sludge thus obtained contains a large proportion of organic matter as well as some nutrients (e.g., phosphorus and nitrogen). However, sludges containing high concentrations of other materials (e.g., heavy metals) which render the stabilised sludges unsuitable for use as fertilisers are excluded (heading 3825). The heading also excludes: (a) animal blood, liquid or dried (heading 0511); (b) crushed or powdered bones, horns or hooves, or fish waste (Chapter 05); (c) flours, meals and pellets of meat or meat offal, of fish or of crustaceans, molluscs or other aquatic invertebrates, unfit for human consumption (heading 2301), and other products of Chapter 23 (oil-cake, brewing or distilling dregs and waste, etc.); (d) bone, wood, peat or coal ash (heading 2621); (e) mixtures of natural fertilisers of this heading with chemical fertilising elements (heading 3105); (f) mixtures of stabilised sewage sludge with potassium or ammonium nitrates (heading 3105); (g) parings and other waste of leather; leather dust, powder and flour (heading 4115).

This heading covers only the following goods, provided that they are not put up in the forms or packages described in heading 3105: (A) Goods which answer to one or other of the descriptions given below: (1) Sodium nitrate, whether or not pure; (2) Ammonium nitrate, whether or not pure; (3) Double salts (whether or not pure) of ammonium sulphate and ammonium nitrate; (4) Ammonium sulphate, whether or not pure; (5) Double salts (whether or not pure) or mixtures of calcium nitrate and ammonium nitrate. Certain mixtures of calcium nitrate and ammonium nitrate may be marketed as "calcium nitrate fertiliser"; (6) Double salts (whether or not pure) or mixtures of calcium nitrate and magnesium nitrate. This product is obtained by treating dolomite with nitric acid; (7) Calcium cyanamide, whether or not pure, whether or not treated with oil; (8) Urea (carbonic acid diamide), whether or not pure. It is used mainly as a fertiliser, but also as animal feed, in the manufacture of urea-formaldehyde resins, in organic synthesis, etc. It should be noted that the mineral or chemical products described in the above limitative list are classified in this heading even if they clearly cannot be used as fertilisers. The heading excludes nitrogenous products of a defined (such as ammonium chloride, heading 2827) or undefined chemical composition, not described above, even if they are used as fertilisers. (B) Fertilisers consisting of mixtures of any of the goods mentioned in paragraph (A) above (e.g., fertilisers consisting of a mixture of ammonium sulphate and ammonium nitrate). (C) Fertilisers consisting of ammonium chloride or of any of the goods mentioned in paragraph (A) or (B) above, mixed with chalk, gypsum or other inorganic non-fertilising substances (e.g., fertilisers obtained

by adding ammonium nitrate by mixing or by introducing the above-mentioned non-fertilizing inorganic substances as a base. Liquid fertilizers consisting of ammonium nitrates (with or without impurities) or urea (with or without impurities), or a mixture of these products in an aqueous or ammonia solution. It should be noted that, unlike the products referred to in (A) above, mixtures falling under (B), (B) il and (D) are classified in this heading only when they are used as fertilizers.

2. Heading 3102 covers only the following goods, provided they are not packaged in forms or packages as provided in heading 3105:

(iii) double salts of ammonium sulphate and ammonium nitrate, with or without impurities;

(b) fertilizers consisting of mixtures of any substances referred to in Note 2(a);

3. Heading 3103 covers only the following goods, provided they are not packaged in forms or packages as provided in heading 3105:

(a) goods which conform to the description given below:

(i) the main slag;

(ii) natural phosphates of heading 2510, calcified or treated at a temperature greater than necessary for the removal of impurities;

(iii) superphosphates (simple, double or triple);

(iv) calcium hydrogen phosphate containing at least 0.2 wt.% fluorine in terms of dry anhydrous product;

(b) fertilizers consisting of mixtures of any of the products referred to in Note 3(a), but excluding the fluoride limit;

(c) fertiliser consisting of any of the products referred to in Note 3(a) or 3(b), but excluding the fluorine limit mixed with chalk, gypsum or other inorganic substances other than fertilizers.

4. Heading 3104 covers only the following goods, provided they are not packaged in forms or packages as provided in heading 3105:

(a) goods which conform to the description given below:

(i) untreated potassium salts (e.g. carnallite, kainite and sylvite);

(ii) potassium chloride, with or without impurities, except as mentioned above in Note 1(c);

(iii) potassium sulfate, with or without impurities;

(iv) potassium magnesium sulfate, with or without impurities;

(b) fertilizers consisting of a mixture of any of the substances referred to in Note 4(a) above.

5. Ammonium dihydrogen phosphate (monoammonium phosphate) and diammonium hydrogen phosphate (diammonium phosphate), whether impurities or not, and mixtures thereof, are to be classified in heading 3105.

6. For the purposes of heading 3105, the term “other fertilizers” means only products used as fertilizers containing at least one of the following nutrients as the main component: nitrogen, phosphorus or potassium.
