5402 51 — Filament yarn of nylon or other polyamides, incl. monofilament of < 67 decitex, single, with a twist of > 50 turns per metre (excl. sewing thread, yarn put up for retail sale, high-tenacity yarn or textured yarn)

Filament yarn of nylon or other polyamides, incl. monofilament of < 67 decitex, single, with a twist of > 50 turns per metre (excl. sewing thread, yarn put up for retail sale, high-tenacity yarn or textured yarn)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Machine translation. The original is the Russian text of the EAEU tariff, and customs goes by it; this translation is for understanding only and has no legal force.

This heading covers synthetic complex threads (other than sewing threads). This heading includes (1) Mononity of linear density less than 67 detex. (2) Complex filaments obtained by adding a certain number of monofilaments (from two to several hundred) usually as odes from the filaments. These threads may be untwisted or steep (single, multi-twisted, or single-twisted). Therefore, they include: (i) single threads consisting of elementary threads wound in parallel without twisting. Also included are a tourniquet not included in Chapter 55; (ii) single threads of such elemental threads twisted immediately at the exit of the filter or in subsequent torsion operations; (iii) multi-course (twisted) or single-course threads made by combining such single threads, including those obtained from the monofilaments of heading 5404 (see paragraph (I)(B)(1) of the general provisions of Section XI). However, the foregoing threads do not fall within this heading if they are strings of heading 5607 or threads packaged for retail sales of heading 5406 (see paragraphs (I)(B)(2) and (3) of the general provisions of section XI). In addition to the usual types of packs in which the textile threads may be presented in a manner different from the packaging for retail sale, some threads of this heading may also be wound in packs without internal carriers (kulichs, etc.). Except as already mentioned, this heading does not include: (a) synthetic monofilaments and flat and similar threads of synthetic textile materials of heading 5404; (b) burn synthetic threads of more than 2 m in length of heading 5501; (c) burn synthetic threads of not more than 2 m in length of heading 5503; (d) tops (broken tourniquet) of heading 5506;

(e) Metallised yarn, including yarn of this heading combined with metal thread in any proportion or covered with metal (heading 5605). Subheading Explanatory Notes. Subheadings 5402 31 to 5402 39 Textured yarn is yarn which has been modified by mechanical or physical processes (e.g., twisting, untwisting, false twisting, compressing, crimping, heat-setting or a combination of several of these processes), as a result of which the individual filaments take the form of spirals, crimps, loops, etc. These deformations may be partially or wholly reduced by a tensile force, but on release of the load the filaments regain the form given to them. Textured yarn is characterised by high bulk or very high stretch. The high elasticity of both types of yarn makes them particularly suitable for use in the manufacture of stretch garments (e.g., acrobats' tights, stockings, underwear), while high-bulk yarns give fabrics softness and a feeling of warmth. Textured yarn differs from non-textured (flat) yarn by the presence of a certain crimp, small loops or reduced parallelism of the filaments in the multifilament yarn. Subheading 5402 46 This subheading covers multifilament yarn consisting of filaments whose molecules are partially oriented. Such yarn is usually flat, is not used directly for the manufacture of materials and must first undergo drawing or draw-texturing processes. It is also known as "partially oriented yarn".

Notes to chapter 54 — Man-made filaments; strip and the like of man-made textile materials 2 items

Notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. Throughout the nomenclature, the term ‘man-made fibres’ means staple fibres and filaments of organic polymers produced by manufacturing processes, either:

(a) by polymerisation of organic monomers to produce polymers such as polyamides, polyesters, polyolefins or polyurethanes, or by chemical modification of polymers produced by this process (for example, poly(vinyl alcohol) prepared by the hydrolysis of poly(vinyl acetate)); or

(b) by dissolution or chemical treatment of natural organic polymers (for example, cellulose) to produce polymers such as cuprammonium rayon (cupro) or viscose rayon, or by chemical modification of natural organic polymers (for example, cellulose, casein and other proteins, or alginic acid), to produce polymers such as cellulose acetate or alginates. The terms ‘synthetic’ and ‘artificial’, used in relation to fibres, mean: synthetic: fibres as defined at (a); artificial: fibres as defined at (b). Strip and the like of heading 5404 or 5405 are not considered to be man-made fibres. The terms ‘man-made’, ‘synthetic’ and ‘artificial’ shall have the same meanings when used in relation to ‘textile materials’.

2. Headings 5402 and 5403 do not apply to synthetic or artificial filament tow of Chapter 55.
