Full name

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 7103 9 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

7103 Precious stones (other than diamonds) and semi-precious stones, whether or not worked or graded but not strung, mounted or set; ungraded precious stones (other than diamonds) and semi-precious stones, temporarily strung for convenience of transport (+): 7103 10 – Unworked or simply sawn or roughly shaped – Otherwise worked: 7103 91 – – Rubies, sapphires and emeralds 7103 99 – – Other

These stones, which generally have a crystalline structure, are used by jewellers, goldsmiths and silversmiths for making ornaments or for decorative purposes because of their colour, lustre, durability and often also their rarity. Some of them are also used in clock and watch movements or in instruments. Owing to their hardness and other special properties they are also used for other industrial purposes (e.g., ruby, sapphire, agate, piezo-electric quartz). The provisions of the second paragraph of the Explanatory Note to heading 7102 apply, mutatis mutandis, to this heading. However, this heading excludes stones of the following types, even if unmounted and unset: (a) unmounted worked sapphires for sound reproducers (heading 8522); (b) stones worked so as to be recognisable as parts of measuring instruments and apparatus, clocks and watches of all kinds or other goods of Chapter 90 or 91; and optical elements of quartz (heading 9001 or 9002). The stones of this heading are therefore, for the most part, stones intended for mounting or setting in jewellery and in goldsmiths' or silversmiths' wares; the heading also covers stones intended for setting in tools of headings 8201 to 8206 or in machinery, etc., of Section XVI (e.g., piezo-electric quartz for high-frequency apparatus, etc.), but provided they are not fitted. This heading excludes stones in the form of articles, e.g., mortars and pestles of cut agate, crosses and rings of agate, garnet goblets and cups, statuettes and ornaments of jade, ash trays and paperweights of agate or onyx, rings for fishing rods, etc.; such articles fall mainly in heading 7116. The stones referred to in this heading may be strung for convenience of transport, provided that this method of assembly is of a temporary nature and that the stones

have not been sorted and are not directly suitable for use as jewellery. Precious or semi-precious stones which have been set or mounted fall in heading 7113, 7114 or 7116 (see the corresponding Explanatory Notes), unless they are covered by other headings under the provisions of Note 1 to this Chapter. This heading covers the precious or semi-precious stones listed in the Annex to this Chapter, the mineralogical names being accompanied by the commercial names; of course, the scope of this heading is limited to those stones and their varieties the quality of which allows them to be used in jewellery, etc. This heading also excludes: (a) certain stones which are not precious, although they belong to the mineral species referred to above, as well as stones lacking the qualities that allow them to be used in jewellery or in goldsmiths' or silversmiths' wares; such stones fall in Chapter 25, 26 or 68; (b) steatite (unworked, heading 2526; worked, heading 6802); (c) jet (unworked, heading 2530; worked, heading 9602); (d) imitations of precious or semi-precious stones made of glass (heading 7018). Subheading Explanatory Notes. Subheading 7103 10 This subheading covers stones roughly shaped by sawing (e.g., into thin strips), by cleaving (along the natural cleavage plane) or by bruting, i.e., stones which have only a preliminary shape and which, naturally, must undergo further working. The strips may also be cut into discs, rectangles, hexagons or octagons, provided that all the surfaces and edges remain rough, matt and unpolished. Subheadings 7103 91 and 7103 99 Subheadings 7103 91 and 7103 99 cover polished or drilled stones, engraved stones (including cameos and intaglios) and stones made up as doublets or triplets. (a) natural or cultivated pearls or precious or semi-precious stones (natural, artificial or reconstructed); or

(b) from precious metals or metals clad with precious metals.

2. (A) Headings 7113, 7114 and 7115 do not include articles in which the precious metal or metal clad with the precious metal is present only as minor components, such as fine fittings or minor finishes (e.g. monograms, rims and edgings), and the provisions of point (b) of note 1 do not apply to these articles.

(B) Heading 7116 does not include articles containing precious metals or metals clad in precious metals (other than small constituent parts).

3. This group does not include:

(B) The term platinum means platinum, iridium, osmium, palladium, rhodium, and ruthenium.

(C) The term “precious or semi-precious stones” does not apply to the materials referred to in Note 2(b) to Chapter 96.

5. In this chapter, any alloy (including an agglomerated mixture and an intermetallic compound) containing a precious metal shall be considered a precious metal alloy if its share in the alloy is not less than 2% by weight. Alloys of precious metals should be classified according to the following rules:

However, this does not apply to metals clad with precious metals, base metals or non-metals coated with precious metals by a galvanic method.

7. Throughout the Nomenclature, the term “precious metal clad metal” means a material made from a metal, on one or more surfaces of which a coating of precious metal is coated by soldering, welding, hot rolling or similar mechanical means. Unless otherwise specified in the context, the term also means a base metal inlaid with a precious metal.

8. Subject to the provisions of Note 1(A) to Section VI, goods corresponding to the description of heading 7112 shall be classified in that heading and in no other heading of the Nomenclature.

Correspondence keys of the Russian Ministry of Economic Development, edition of 20.07.2023. The ministry’s caveat:
