0904 21 — Fruits of the genus Capsicum or of the genus Pimenta, dried, neither crushed nor ground
Fruits of the genus Capsicum or of the genus Pimenta, dried, neither crushed nor ground
Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

(1) Pepper of the genus Piper. This term means the seeds or fruits of all species of plants of the genus Piper, except the pepper cubeb (heading 1211). The main commodity variety is pepper of the type Piper nigrum black or white. Black pepper grains are irradiated from immature fruits by natural drying or smoking, sometimes after treatment with boiling water. White grains are obtained from near-mature fruits, in which the fruit pulp and outer shell of the seeds are removed by soaking or light fermentation. White pepper is often also obtained from black pepper grains by removing their shell by crushing. White pepper, which is actually yellowish-gray, is not as sharp as black. Another type of pepper is long Indian pepper (Piper longum). This heading also includes pepper dust and pepper production waste. Some foods incorrectly referred to as Indian, Turkish, Spanish, cayenne or Jamaican peppers are actually peppers of the genus Pimenta. (2) Dried or crushed or ground fruits of the genus Capsicum or the genus Pimenta. The fruits of the genus Capsicum usually belong to the species Capsicum frutescens or Capsicum annuum and include two main groups: red pod pepper and paprika. They are very diverse (cayenne pepper, Sierra Leon and Zanzibar pepper, Spanish and Hungarian paprika, etc.). The fruits of the genus Pimenta include Jamaican pepper (also known as clove pepper, English pepper, and scented pepper). All these fruits have a common property – bitter, strong, burning and persistent taste; however, there are other representatives of the genus Capsicum, not having sharpness (for example, Capsicum annuum var. grossum). This heading does not cover uncut or ungrounded fresh fruits of the genus Capsicum or of the genus Pimenta (heading 0709).

85 is a very low-grade variety known as vanillon (derived from the species Vanilla pompona), soft, almost viscous and always open. This heading does not cover: (a) vanilla residue (sometimes erroneously known as “rubber d vanilla” or “vanilla extract”) (heading 1302); (b) vanilla sugar (heading 1701 or 1702); (c) vanillin (synthetic compound with the smell of vanilla) (heading 2912).
