1209 99 10 — Forest-tree seed for sowing

Forest-tree seed for sowing

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 1209 3 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

This heading covers all seeds, fruit and spores of a kind used for sowing. It covers such products even if they have lost their germinating power. However, it does not cover the products mentioned at the end of this Explanatory Note which, although they may be used for sowing, are classified in other headings of the Nomenclature because they are generally put to other uses. The heading covers seeds of beet, of grasses or other herbaceous plants (lucerne, sainfoin, clover, fescue, rye grass, meadow grass, timothy, etc.), seeds of ornamental flowers, of vegetables, of forest trees (including seed-bearing cones) and of fruit trees, of vetches (other than those of the species Vicia faba, i.e., field beans), of lupines, of tamarind, of tobacco, and seeds (other than those used, as such, primarily in perfumery, pharmacy or for insecticidal, fungicidal or similar purposes) of plants yielding products of heading 1211. Products of this heading (particularly grass seeds) may be placed, together with small particles of fertiliser, on a paper base and covered with a thin layer of wadding held in place by a plastic grid. The heading excludes: (a) mushroom spawn (heading 0602);

(b) leguminous vegetables and sweet corn (Chapter 07); (c) fruit of Chapter 08; (d) spices and other products of Chapter 09; (e) cereal grains (Chapter 10); (f) oil seeds and oleaginous fruits of headings 1201 – 1207; (g) seeds and fruits of a kind used, as such, primarily in perfumery, pharmacy or for insecticidal, fungicidal or similar purposes (heading 1211); (h) locust beans (heading 1212).
