Peaches incl. nectarines, prepared or preserved, containing no spirit but with added sugar, with sugar content of > 9% but <= 15%, in immediate packings of a net content of <= 1 kg

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

This heading covers fruit, nuts and other edible parts of plants, whether whole, in pieces or crushed, as well as mixtures thereof, prepared or preserved otherwise than by any of the processes specified in other Chapters or in the preceding headings of this Chapter. The heading includes, inter alia: (1) almonds, peanuts, areca (or betel) nuts and other nuts, roasted without oil or in oil or fat, whether or not containing, or coated with, vegetable oil, salt, flavourings, spices or other additives; (2) "peanut butter" (or ground peanuts), a paste made by grinding roasted peanuts, whether or not with added salt or oil; (3) fruit (including fruit peel and seeds) preserved in water, in syrup, in chemicals or in alcohol; (4) fruit pulp, sterilised, whether or not cooked; (5) whole fruit such as peaches, apricots, oranges (whether or not peeled, with or without their stones or pips), crushed and sterilised, whether or not with added water or sugar syrup, but in a quantity insufficient to render them suitable for direct consumption as beverages. When, as a result of the addition of a sufficient quantity of water or sugar syrup, these products have become suitable for direct consumption as beverages, they are classified in heading 2202; (6) fruit which has been cooked. However, fruit cooked by steaming or boiling in water and then frozen is classified in heading 0811; (7) stems, roots and other edible parts of plants (e.g., ginger, angelica, yams, sweet potatoes, hop shoots, vine leaves, palm hearts), preserved in syrup or otherwise prepared or preserved; (8) tamarind pods in sugar syrup; (9) fruit, nuts and other edible parts of plants (other than vegetables), preserved by sugar and put up in syrup (e.g., marrons glacés or ginger in syrup), whatever the type of packing;

(10) fruit preserved by osmotic dehydration. The term "osmotic dehydration" refers to a process whereby pieces of fruit are subjected to prolonged soaking in a concentrated sugar syrup so that much of the water and natural sugar is replaced by sugar from the syrup. The fruit may subsequently be air-dried to further reduce the moisture content. The products of this heading may be sweetened with synthetic sweetening agents (e.g., sorbitol) instead of sugar. Other substances (e.g., starch) may be added to the products of this heading, provided that they do not alter the essential character of the fruit, nuts or other edible parts of plants. The products of this heading are generally put up in cans or airtight containers or in casks, barrels or similar containers. The heading also excludes products consisting of a mixture of plants or parts of plants (including seeds or fruits) of different species or consisting of plants or parts of plants (including seeds or fruits) of a single species or of different species mixed with other substances such as one or more plant extracts, which are not consumed as such, but which are of a kind used for making herbal infusions or herbal "teas" (e.g., heading 0813, 0909 or 2106). The heading excludes fruit, nuts or other edible parts of plants made into sugar confectionery (including that based on natural honey) of heading 1704. The heading further excludes mixtures of plants, parts of plants, seeds or fruit (whole, cut, crushed, ground or powdered) of species falling in different Chapters (e.g., Chapters 07, 09, 11, 12), not consumed as such, but of a kind used either directly for flavouring beverages or for preparing extracts for the manufacture of beverages (Chapter 09 or heading 2106).

5. For the purposes of heading 2007, the expression ‘obtained by cooking’ means obtained by heat treatment at atmospheric pressure or under reduced pressure to increase the viscosity of a product through reduction of water content or other means.

6. For the purposes of heading 2009, the expression ‘juices, unfermented and not containing added spirit’ means juices of an alcoholic strength by volume (see note 2 to Chapter 22) not exceeding 0,5 % vol.

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheading 2005 10, the expression ‘homogenised vegetables’ means preparations of vegetables, finely homogenised, put up for retail sale as food suitable for infants or young children or for dietetic purposes, in containers of a net weight content not exceeding 250 g. For the application of this definition, no account is to be taken of small quantities of any ingredients which may have been added to the preparation for seasoning, preservation or other purposes. These preparations may contain a small quantity of visible pieces of vegetables. Subheading 2005 10 takes precedence over all other subheadings of heading 2005.

2. For the purposes of subheading 2007 10, the expression ‘homogenised preparations’ means preparations of fruit, finely homogenised, put up for retail sale as food suitable for infants or young children or for dietetic purposes, in containers of a net weight content not exceeding 250 g. For the application of this definition, no account is to be taken of small quantities of any ingredients which may have been added to the preparation for seasoning, preservation or other purposes. These preparations may contain a small quantity of visible pieces of fruit. Subheading 2007 10 takes precedence over all other subheadings of heading 2007.

3. For the purposes of subheadings 2009 12, 2009 21, 2009 31, 2009 41, 2009 61 and 2009 71, the expression ‘Brix value’ means the direct reading of degrees Brix obtained from a Brix hydrometer or of refractive index expressed in terms of percentage sucrose content obtained from a refractometer, at a temperature of 20 °C or corrected for 20 °C if the reading is made at a different temperature.

2. (a) The content of the various sugars expressed as sucrose (sugar content) in products of this Chapter corresponds to the refractometer reading at 20 °C multiplied by the following coefficient:

0.93 for products of subheadings 2008 20 to 2008 80, 2008 93, 2008 97 and 2008 99, or

0.95 for products of other headings.

However, the content of various sugars expressed as sucrose (sugar content) in the following products of this group:

products derived from seaweed and other algae prepared or preserved in a manner not specified in Chapter 12;

- products derived from cassava, maranta, salep, earthen pear or artichoke, sweet potatoes or sweet potatoes and similar root vegetables and tubers of high starch or inulin content of heading 0714;

products produced on the basis of grape leaves;

corresponds to the value obtained by processing the measurement results by high-performance liquid chromatography ("HPLC method") using the following formula:

S + (G + F) x 0.95, where

S is the sucrose content determined by HPLC method;

G is the glucose content determined by HPLC method;

F is the fructose content determined by HPLC method.

(b) “Brix number” in the subheadings of heading 2009 corresponds to the numerical reading of the refractometer at 20°C.

3. Products of subheadings 2008 20 to 2008 80, 2008 93, 2008 97 and 2008 99 shall be regarded as containing sugar additives if the "sugar content" in them exceeds by weight the percentage specified below, depending on the type of fruit or part of the plant consumed:

pineapples and grapes: 13%

Other fruits, including fruit mixtures, and other plant parts consumed: 9%
