Wine of fresh grapes, including fortified wines; grape must other than that of heading 2009: sparkling wine: other

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 2204 3 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

2204 Natural grape wines, including fortified ones; protective must of wines, other than those specified in heading 2009: 2204 10 – sparkling wines – other wines; grape must, the fermentation of which was prevented or suspended by the addition of alcohol: 2204 21 – in vessels with a capacity of 2 liters or less than 2204 22 – in vessels with a capacity of more than 2 liters, but not more than 10 l 2204 29 – other 2204 30 – other grape must

(I) Natural grape wines. Wine covered in this heading is the end product of the alcoholic fermentation of freshly squeezed grape must. This heading includes: (1) Ordinary wines (red, white or pink).

(2) Fortified wine, or spirited wine. (3) Sparkling wines. These wines are saturated with carbon dioxide either by secondary fermentation in dug containers (real sparkling wines), or by adding this gas artificially after being bottled (carbonated wines). (4) Dessert wines (sometimes called liquor) These wines are rich in alcohol and are usually obtained from a must with a high content of sa hara, which is only converted into alcohol by fermentation. In some cases, they are fastened by adding alcohol or concentrated wort with added alcohol. Dessert (or liquor) wines include, inter alia, such wines as canari, Cypriot (Cyprus), cristi lacrima, Madera, Malaga, Marsala, Port, Malvasia, Samos and Sherry. This heading does not cover (a) beverages based on wine of heading 2205; (b) medicinal products of heading 3003 or 3004. (II) Grape must. Grape must obtained by pressing fresh grapes is a greenish-yellow muddy liquid with a sweet taste. It contains a mixture of sugars (glucose and fructose), acids (wine, apple, etc.), protein, minerals and plant gums, as well as aromatic substances that give wine its characteristic smell and taste. Grape wort is usually fermented spontaneously (and sugar is converted into alcohol); the end product of this fermentation is wine. The natural course of wort fermentation can be inhibited by a process known as "mutation," which can either slow fermentation or stop it altogether. Mutation can be carried out in various ways: (1) by adding salicylic acid or other antiseptics; (2) by saturating the wort with sulfur dioxide; (3) by adding alcohol. This type of product is often consumed as wine without further processing. Other products known as mystelli are used in the production of liqueur wines and aperitifs, etc.; (4) by refrigeration. It should be noted that this group includes partially fermented vinograd bottom must, regardless of whether fermentation is suspended or not, as well as unfermented grape must with added alcohol, and the alcohol concentration in these two products exceeds 0.5 vol.%. This heading does not include grape juice and grape must, concentrated or unconcentrated, unfermented or with an alcohol concentration not exceeding 0.5 vol.% (heading 2009).

(a) "actual alcohol concentration by volume" means the number of volumes of pure alcohol at 20 °C in 100 volumes of product at that temperature;

(b) “potential alcohol concentration by volume” means the number of volumes of pure alcohol at 20 °C that can be obtained by complete fermentation of the sugars contained in 100 volumes of product at that temperature;

(c) "total alcohol concentration by volume" means the sum of the actual alcohol concentration by volume and the potential alcohol concentration by volume;

(d) “natural alcohol concentration by volume” means the total alcohol concentration by volume in a product prior to any enrichment;

(e) "about %" means the concentration of alcohol by volume.

3. For the purposes of subheading 2204 30 100 0, “Vine drying in fermentation” means a product obtained by fermentation of grape must having an actual alcohol concentration of more than 1 vol.% and less than three-fifths of the total alcohol concentration by volume.

4. For subheadings 2204 21, 2204 22 and 2204 29:

(A) "total dry extract" means the content in grams per litre of a product of all substances which, under given physical conditions, do not evaporate. The total dry extract should be determined by a densimeter at a temperature of 20 °C.

(B) (a) The presence in products of subheadings 2204 21 110 0 to 2204 21 980 0, 2204 22 110 0 to 2204 22 980 0 and 2204 29 110 to 2204 29 980 of specific amounts of total dry extract per litre referred to in paragraphs 1, 2, 3 and 4 shall not affect their classification:

(1) products with an actual alcohol concentration of not more than 13 vol.%: 90 g or less of total dry extract per 1 liter;

(2) products with an actual alcohol concentration of more than 13 vol.%, but not more than 15 vol.%: 130 g or less of total dry extract per 1 liter;

(3) products with an actual alcohol concentration of more than 15 vol.%, but not more than 18 vol.%: 130 g or less of total dry extract per 1 liter;

(4) products with an actual alcohol concentration of more than 18 vol.%, but not more than 22 vol.%: 330 g or less of total dry extract per 1 liter.

Products with a total dry extract exceeding the maximum value specified above for each category shall be classified in the following category, unless the total dry extract exceeds 330 g/l, in which case the products shall be classified in subheadings 2204 21 980 0, 2204 22 980 0 and 2204 29 980.

(b) The above rules do not apply to products included in subheadings 2204 21 230 0, 2204 22 110 0 and 2204 29 110.

5. In subheadings 2204 21 110 0 to 2204 21 980 0, 2204 22 110 0 to 2204 22 980 0 and 2204 29 110 to 2204 29 980:

(a) a grape must whose fermentation is suspended by the addition of alcohol, i.e. a product which:

has an actual alcohol concentration of at least 12 vol.% but less than 15 vol.%, and
