Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

3205 Colored varnishes; preparations based on coloured varnishes referred to in note 3 to this chapter

Colored varnishes are preparations insoluble in water obtained by fixing a natural coloring substance (animal or vegetable origin) or a synthetic organic coloring substance (soluble or insoluble in water) usually on a mineral basis (barium sulfate, calcium sulfate, aluminum oxide, kaolin, talc, silica, infusor earth, calcium carbonate, etc.). The fixation of the coloring substance on the basis is usually achieved: (1) by precipitating the coloring substance on the base using a precipitator (tannin, barium chloride, etc.) or by precipitating the coloring substance and base; (2) by dyeing the base with a solution of coloring substance; (3) by careful mechanical mixing of the insoluble coloring substance with an inert base. Colored varnishes are not to be mixed with certain other products, such as synthetic organic dyes insoluble in water, in which mineral elements are an integral part of the molecule, for example, synthetic organic dyes which have become insoluble in the form of their metal salts (for example, calcium salts of sulfonated dyes and salts of basic dyes with complex acids of phosphorus, molybdenum and tungsten) (heading 3204). Colored varnishes are mainly prepared from synthetic organic dyes (heading 3204) with high resistance to oxidation, such as azo dyes, cubic dyes obtained from anthraquinone, or alysis arin dyes. These varnishes are used to produce printing paint, wallpaper and oil paints. Colored varnishes may also be prepared from an organic colouring substance of animal or vegetable origin (i.e., a substance of heading 3203). These include, inter alia, cochineal carmine varnish, usually obtained by treating an aqueous solution of cochineal extract with alum and used mainly in the production of watercolors and in the coloring of syrups, confectionery or liqueurs; sandalwood, yellow wood and mahogany varnishes, etc. These products are often in powder form. This heading covers concentrated dispersions of coloured varnishes in plastics, rubber, plasticizers or other carrier media. These dispersions are usually in the form of small plates or lumps and are used as raw materials for dyeing rubber, plastics, etc. in mass. This heading also covers certain other preparations based on coloured varnishes used for dyeing any material or used as ingredients in the manufacture of colouring preparations. However, the preparations referred to in the last sentence of note 3 to this chapter are not included. This heading does not cover Japanese (or Chinese) varnish (heading 1302).

1. This group does not include:

(a) individual elements or compounds of a specified chemical composition (other than products of heading 3203 or 3204, inorganic products used as phosphors (heading 3206), glass obtained from fused quartz or other fused silica in the forms specified in heading 3207, and dyes and other dyes packaged in molds or packaging for retail sale, heading 3212);

(b) Tannats or other tannin derivatives of headings 2936 to 2939, 2941 or 3501 to 3504; or

(c) Mastics of asphalt or other bitumen mastics (heading 2715).

2. Heading 3204 covers mixtures of stabilized diazonium salts and components for producing azo dyes.

3. Headings 3203 to 3206 also cover products made of colouring substances (including, in the case of heading 3206, colouring pigments of heading 2530 or of Chapter 28, metal flakes or metal powders) used for dyeing any material or as components in the manufacture of colouring agents. These headings do not, however, cover pigments dispersed in non-aqueous media, liquid or pasty, used in the manufacture of paints, including enamel (heading 3212), or other products of headings 3207 to 3210, 3212, 3213 and 3215.

4. Heading 3208 covers solutions (other than collodes) consisting of any products of headings 3901 to 3913 in volatile organic solvents where the solvent content exceeds 50% by weight of the solution.

5. The term “coloring substance” in this chapter does not refer to products used as fillers of oil paints, whether or not suitable for adhesive paints.

6. The term "embossing foil" in heading 3212 means only thin sheet materials used for imprinting, for example, on book covers or hat ribbons, and consisting of:

(a) metal powder (including precious metal powder) or pigment agglomerated with glue, gelatin or other binder; or

(b) metal (including precious metal) or pigment applied to a sheet substrate of any material.
