Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 3212 3 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

3212 Pigments (including metal powders and flakes) dispersed in non-aqueous media, liquid or pasty e used in the manufacture of paints (including enamel); foils for embossing; dyes and other dyes packaged in molds or packages for retail sale: 3212 10 – embossing foil 3212 90 – other

(a) Pygments (including metallic powders and cotton) Dispersed in non-aqueous media, liquid or paste, used in the manufacture of paints (including enamel) These products are concentrated dispersions of pigments (including aluminum or other metallic on rods and flakes) in a non-aqueous medium (e.g., drying oils, white spirits, live turpentine, wood or sulfate turpentine or lacquer), liquid or pasty, used in the production of paints or enamels. This category of goods also includes centered dispersions, sometimes called “pearl essences”, such as: (a) a natural pearl pigment containing guanine and hypoxanthine and obtained from the scales of certain fish, or (b) synthetic pearl pigment t (for example, mica coated with bismuth chloride or titanium dioxide), in a varnish or polish (for example, in nitrocellulosene) or in a synthetic polymer solution. These products are used in the production of imitation of pearls, nail polishes or other paints and enamels. These products (also known as "glue foil") consist of thin sheets or of: (1) metal powder (including precious metal powder) or pigments agglomerated with glue, gelatin or other binder; or (2) metal (including precious metal) or pigments deposited by evaporation, cathode spraying, etc. on any sheet material-base (e.g., paper, plastic, etc.). They are used with the application of pressure (and usually heating) to print on the covers of books, hat ribbons, etc., and printing is done both manually and by machine. Metal foil produced by rolling or cold forging is classified according to the metal of which it is made (for example, gold foil in heading 7108, copper foil in heading 7410, aluminum foil in heading 7607).

(C) DYES AND OTHER COLOURING MATTER PUT UP IN FORMS OR PACKINGS FOR RETAIL SALE These products do not form films and generally consist of mixtures of colouring matter with other substances (e.g., inert diluents, surface-active agents promoting the penetration and fixing of the colouring matter). Mordants are sometimes also added. They are included here only if: (1) put up in packings for retail sale (e.g., sachets of powder, bottles of liquid product) for use as dyes; or (2) presented in forms (e.g., balls, tablets or similar forms) clearly intended for retail sale. The dyes covered by this heading are mainly used for household purposes and are generally sold as "household dyes" (e.g., dyes for clothing, footwear, furniture). This heading also covers special dyes used in laboratories, for example, for staining microscope preparations. The heading excludes: (a) artists', students' or signboard painters' colours, modifying tints, amusement colours and the like, in tablets, tubes, jars, bottles, pans or in similar forms or packings (heading 3213); (b) printing ink (heading 3215); (c) theatrical make-up and other make-up preparations (heading 3304); (d) hair dyes (heading 3305); (e) coloured pencils and pastels (heading 9609).

Notes

Machine translation. The original is the Russian text of the EAEU tariff, and customs goes by it; this translation is for understanding only and has no legal force.

1. This group does not include:

(a) individual elements or compounds of a specified chemical composition (other than products of heading 3203 or 3204, inorganic products used as phosphors (heading 3206), glass obtained from fused quartz or other fused silica in the forms specified in heading 3207, and dyes and other dyes packaged in molds or packaging for retail sale, heading 3212);

(b) Tannats or other tannin derivatives of headings 2936 to 2939, 2941 or 3501 to 3504; or

(c) Mastics of asphalt or other bitumen mastics (heading 2715).

2. Heading 3204 covers mixtures of stabilized diazonium salts and components for producing azo dyes.

3. Headings 3203 to 3206 also cover products made of colouring substances (including, in the case of heading 3206, colouring pigments of heading 2530 or of Chapter 28, metal flakes or metal powders) used for dyeing any material or as components in the manufacture of colouring agents. These headings do not, however, cover pigments dispersed in non-aqueous media, liquid or pasty, used in the manufacture of paints, including enamel (heading 3212), or other products of headings 3207 to 3210, 3212, 3213 and 3215.

4. Heading 3208 covers solutions (other than collodes) consisting of any products of headings 3901 to 3913 in volatile organic solvents where the solvent content exceeds 50% by weight of the solution.

5. The term “coloring substance” in this chapter does not refer to products used as fillers of oil paints, whether or not suitable for adhesive paints.

6. The term "embossing foil" in heading 3212 means only thin sheet materials used for imprinting, for example, on book covers or hat ribbons, and consisting of:

(a) metal powder (including precious metal powder) or pigment agglomerated with glue, gelatin or other binder; or

(b) metal (including precious metal) or pigment applied to a sheet substrate of any material.
