3701 20 — Instant print film in the flat, sensitised, unexposed, whether or not in packs

Instant print film in the flat, sensitised, unexposed, whether or not in packs

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Machine translation. The original is the Russian text of the EAEU tariff, and customs goes by it; this translation is for understanding only and has no legal force.

Explanatory notes to heading 3701 3 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

3701 Flat, sensitized, unexposed, of any material other than paper, cardboard or textile; flat for instant photography, sensitized, unexposed, in packed or unpacked: 3701 10 – X-ray 3701 20 – for instant photography 3701 30 – plates and films, etc., the length of either side of which is more than 255 mm – other: 3701 91 – for color photography (polychrome) 3701 99 – other

(A) Photographic plates and photographic films of any material other than paper, cardboard or textiles. Such plates and films are flat (i.e. not rolled), including disc-shaped films, are unexposed materials and are usually coated with a sensitized photographic emulsion. They may be made of any material other than paper (e.g. paper "plates" used to produce negatives), cardboard or textile materials (heading 3703). The most commonly used materials are glass and cellulose acetate, polyethylene terephthalate or other plastics (for batch film or format film), as well as metal or stone (for photomechanical processes). Some plates, which after exposure and processing will be used for printing, are not covered with emulsion, but entirely sludge and to a greater extent consist of photosensitive plastics. They can be mounted on a substrate of metal or other material. Some of these plates should have their own degree of sensitivity, increased before exposure, and other plates should have a degree of curing irradiated sections, (thermally) increased after irradiation. These products have different purposes, for example: (1) plates, format films for amateur or professional photography. (2) X-rays and flat films, including those used for dental radiography. These products usually have a sensitive emulsion on both sides. (3) Plates for photomechanical processes used for photoengraving, photolithography, etc. (4) Special plates and films for use in micrography, photomicrography, astronomy, cosmic ray photography, aerial photography, etc. (B) Flat films for instant photography. They are also sensitized, unexposed and flat. Flat films for instant photography consist of a sensitive sheet of any material (negative), a sheet of specially processed paper (positive) and a developer for instantaneous receipt of the finished product.

A positive photograph. Films for instant photography can be in packets (a cassette or tin box containing several sheets of such film) intended for charging directly into the camera, or in boxes containing several separately used sheets. However, rolled snapshot films, sibilised, unexposed, are not included in this heading (heading 3702). This heading also excludes: (a) unsensitized plates and flat films (classified according to the materials of which they are made); (b) unexposed roll films (heading 3702).

Notes to chapter 37 — Photographic or cinematographic goods 4 items

Notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. This chapter does not cover waste or scrap.

2. In this chapter, the word ‘photographic’ relates to the process by which visible images are formed, directly or indirectly, by the action of light or other forms of radiation on photosensitive, including thermosensitive, surfaces.

Additional notes

Machine translation. The original is the Russian text of the EAEU tariff, and customs goes by it; this translation is for understanding only and has no legal force.

1. In the case of sound films imported in two tapes (one tape contains only an image, the second tape contains sound), each tape shall be included in the appropriate heading.

2. The term "chronicle films" (subheading 3706 90 520 0) means films less than 330 m long and reflecting current political, sports, military, scientific, literary, folklore, tourist, social and other events.
