Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

This heading covers: (1) Polyacetals. These are polymers obtained from an aldehyde, generally formaldehyde, and characterised by the presence of acetal functions in the polymer chain. They should not be confused with the poly(vinyl acetals) of heading 3905, in which the acetal functions are substituents on the polymer chain. This group of polymers includes acetal copolymers and belongs to the engineering polymers used for the manufacture of ring bearings, cams, automotive tool boxes, door handles, impellers for pumps and blowers, shoe heels, mechanical toys, water pipe fittings, etc. (2) Other polyethers. These are polymers obtained from epoxides, glycols or similar materials, characterised by the presence of ether functions in the polymer chain. They should not be confused with the poly(vinyl ethers) of heading 3905, in which the ether functions are substituents on the polymer chain. The most important members of this group are poly(ethylene oxide), poly(propylene oxide) and poly(phenylene oxide) (PPO) (more accurately called poly(dimethylphenylene oxide)). These products have wide applications: PPO is used, like the polyacetals, as an engineering plastic, and poly(propylene oxide) as an intermediate in the production of polyurethane foam. The heading also covers pegylated (with polymers of polyethylene glycol (or PEG)) derivatives of products of Chapter 29 (sub-Chapters I to X and headings 2940 and 2942). Pegylated products whose non-pegylated forms fall either in Chapter 29 (headings 2936 to 2939 and 2941) or in Chapter 30 are excluded and, as a rule, are classified in the same heading as their non-pegylated forms. (3) Epoxide resins. These are polymers obtained, for example, by condensation of epichlorohydrin (1-chloro-2,3-epoxypropane) with bisphenol A (4,4'-isopropylidenediphenol), with novolac (phenol-aldehyde) resin or with other polyhydroxy compounds, or by epoxidation of unsaturated polymers. Irrespective of the basic polymer structure, these resins are characterised by the presence of reactive epoxide groups which enable them to cross-link readily during use, e.g., on the addition of an amino compound, an organic acid or anhydride, a boron trifluoride complex or an organic polymer. The range of epoxide resins covers low-viscosity liquids and solids of high melting point; they are used as surface coatings, adhesives, moulding or casting resins, etc. Epoxidised animal or vegetable oils fall in heading 1518. (4) Polycarbonates. These are polymers obtained, for example, by condensation of bisphenol A with phosgene (carbonyl chloride) or with diphenyl carbonate, and characterised by the presence of carbonic acid ester units in the polymer chain. They are used in industry, particularly for moulding articles and for producing glazing.

(5) Polyesters. These polymers are characterised by the presence of the ester carboxyl group in the polymer chain and are obtained, for example, by the condensation of a polyhydric alcohol and a polycarboxylic acid. They are thus distinguished from the polyvinyl esters of heading 3905 and the polyacrylic esters of heading 3 906, in which the ester groups are substituents in the polymer chain. Polyesters include: (a) Alkyd resins. Polycondensation products of polyalcohols and polyfunctional acids and their anhydrides, at least one of which must be partly or wholly trifunctional or higher, modified with other substances such as fatty acids or animal or vegetable oils, monofunctional acids or alcohols, rosin. They do not include oil-free alkyds (see Item (d) below). These resins are used mainly as high-grade coatings and varnishes and are usually supplied in the form of viscous products or as solutions. (b) Polyallyl esters. A special group of unsaturated polyesters (for the term "unsaturated" see Item (e) below) derived from esters of allyl alcohol and dibasic acids, e.g., from diallyl phthalate. They are used as binders for laminates, coatings, varnishes, and for making materials providing high transparency to electromagnetic waves. (c) Polyethylene terephthalate (PET). A polymer usually obtained by the esterification of terephthalic acid with ethylene glycol or by the reaction of dimethyl terephthalate with ethylene glycol. Besides its very important use in the textile industry, it is used, for example, in the manufacture of packaging films, magnetic tapes, bottles for soft drinks. Polyethylene terephthalate having a viscosity number of 78 ml/g or higher is used mainly for the manufacture of bottles. A viscosity number of 78 ml/g or higher corresponds to an intrinsic viscosity value of 0.7 dl/g or higher. The viscosity number is calculated in accordance with ISO Standard 1628-5. (d) Polylactide. Usually produced from lactic acid obtained by synthesis or by fermentation (this process uses raw materials consisting mainly of hexoses or of compounds readily split into hexoses, e.g., sugars, molasses, sugar beet juice, sulphite liquors, whey or starches). The lactic acid is converted into the cyclic lactide dimer, whose ring structure is opened during the final polymerisation stage. Applications include the production of textile fibres, packaging materials and medical materials. (e) Other polyesters. They may be unsaturated or saturated. Unsaturated polyesters are those which have sufficient ethylenic unsaturation to allow them to be readily cross-linked (or to be already cross-linked) with monomers having an ethylenic bond, forming thermosetting materials. Unsaturated polyesters include polyallyl esters (see Item (b) above) and other polyesters (including oil-free alkyds) of an unsaturated acid, e.g., maleic or fumaric acid. These products, which are usually in the form of liquid prepolymers, are mainly used for

production of fiberglass reinforced layered plastics and thermoset transparent cast products. Saturated polyesters include polymers on the basis of e terephthalic acid, for example, polybutylene terephthalate and saturated, oil-free alkyd resins. They are mainly used for textile fibers and films. For the classification of polymers (including copolymers), chemically modified polymers and polymer mixtures, see the general provisions of this chapter.

For the purposes of this Chapter, unless otherwise specified in the context, copolymers (including copolycondensates, additive copolymerization products, block copolymers and grafted copolymers) and mixtures of polymers are classified in the same heading as polymers of a comonomer unit predominant by weight over any other individual comonomer unit. In this note, comonomeric units forming polymers falling within the same heading are to be considered together.

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. Within any one heading of this chapter, polymers (including copolymers) and chemically modified polymers are to be classified according to the following provisions:

(a) where there is a subheading named ‘Other’ in the same series:

(1) the designation in a subheading of a polymer by the prefix ‘poly’ (for example, polyethylene and polyamide-6,6) means that the constituent monomer unit or monomer units of the named polymer taken together must contribute 95 % or more by weight of the total polymer content;

(2) the copolymers named in subheadings 3901 30, 3901 40, 3903 20, 3903 30 and 3904 30 are to be classified in those subheadings, provided that the comonomer units of the named copolymers contribute 95 % or more by weight of the total polymer content;

(3) chemically modified polymers are to be classified in the subheading named ‘Other’, provided that the chemically modified polymers are not more specifically covered by another subheading;

(4) polymers not meeting (1), (2) or (3) above, are to be classified in the subheading, among the remaining subheadings in the series, covering polymers of that monomer unit which predominates by weight over every other single comonomer unit. For this purpose, constituent monomer units of polymers falling in the same subheading shall be taken together. Only the constituent comonomer units of the polymers in the series of subheadings under consideration are to be compared;

(b) where there is no subheading named ‘Other’ in the same series:

(1) polymers are to be classified in the subheading covering polymers of that monomer unit which predominates by weight over every other single comonomer unit. For this purpose, constituent monomer units of polymers falling in the same subheading shall be taken together. Only the constituent comonomer units of the polymers in the series under consideration are to be compared;

(2) chemically modified polymers are to be classified in the subheading appropriate to the unmodified polymer. Polymer blends are to be classified in the same subheading as polymers of the same monomer units in the same proportions.

2. For the purposes of subheading 3920 43, the term ‘plasticisers’ includes secondary plasticisers.
