4401 22 — Wood in chips or particles (excl. those of a kind used principally for dyeing or tanning purposes, and coniferous wood)

Wood in chips or particles (excl. those of a kind used principally for dyeing or tanning purposes, and coniferous wood)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

4401 Fuel wood, in logs, in billets, in twigs, in faggots or in similar forms; wood in chips or particles; sawdust and wood waste and scrap, whether or not agglomerated in logs, briquettes, pellets or similar forms: – Fuel wood, in logs, in billets, in twigs, in faggots or in similar forms: 4401 11 – – Coniferous 4401 12 – – Non-coniferous – Wood in chips or particles: 4401 21 – – Coniferous 4401 22 – – Non-coniferous – Sawdust and wood waste and scrap, agglomerated in logs, briquettes, pellets or similar forms: 4401 31 – – Wood pellets 4401 39 – – Other 4401 40 – Sawdust and wood waste and scrap, not agglomerated

This heading covers: (A) Fuel wood, generally in the form of: (1) short pieces of logs, usually with the bark on; (2) split logs or billets; (3) branches, faggots, irregular sticks, vine stems, tree stumps and roots. (B) Wood in chips or particles, i.e., wood mechanically reduced to small chips (flat, rigid and roughly cut) or to particles (thin and flexible), of a kind used for making wood pulp by mechanical processes, chemical processes or a combination of both, or for the manufacture of fibreboard or particle board. Subject to Note 6 to this Chapter, the heading also covers similar products obtained, for example, from bamboo. Pulpwood in the round or roughly squared on four sides is excluded (heading 4403). (C) Sawdust, whether or not agglomerated in logs, briquettes, pellets or similar forms. (D) Wood waste and scrap, not usable as timber. These materials are used, in particular, for pulping (paper-making) and for the manufacture of particle board and fibreboard, and also in

as fuel. Waste and scrap include waste from sawing and planing of wood; manufacturing waste; broken boards; old crates unusable as such; bark and shavings (whether or not agglomerated in logs, briquettes, pellets or similar forms); other joinery and carpentry waste and scrap; spent dyewood and tanning wood or bark. The heading also covers wood waste and scrap arising from the erection and dismantling of building structures, which cannot be used as timber. However, wooden articles thus obtained which can be re-used as such (e.g., beams, planks, doors) are classified in the appropriate headings. The heading also excludes: (a) wood and wood waste, coated with resin or otherwise prepared, used as firelighters (heading 3606); (b) logs used for pulping or for the manufacture of matches (heading 4403); unlike fuel logs, these logs are carefully sorted, may be debarked or peeled and, as a rule, should not include broken, split, bent, knotty or forked logs; (c) chipwood used for plaiting or for the manufacture of sieves, chip-boxes, pill-boxes, etc., and wood shavings used for the manufacture of vinegar or for the clarification of liquids (heading 4404); (d) wood wool and wood flour (heading 4405).

4. The articles of heading 4410, 4411 or 4412 may be given the profile characteristic of the articles of heading 4409 and may be curved, corrugated, perforated, cut or shaped in a different shape than square or rectangular, or subjected to any other treatment, provided that this does not give them the properties of the articles of other headings.

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. 1. For the purposes of subheading 4401 31, the expression ‘wood pellets’ means by-products, such as cutter shavings, sawdust or chips, of the mechanical wood-processing industry, furniture-making industry or other wood-transformation activities, which have been agglomerated either directly by compression or by the addition of a binder in a proportion not exceeding 3 % by weight. Such pellets are cylindrical, with a diameter not exceeding 25 mm and a length not exceeding 100 mm.

2. For the purposes of subheading 4401 32, the expression ‘wood briquettes’ means by-products such as cutter shavings, sawdust or chips, of the mechanical wood processing industry, furniture making or other wood transformation activities, which have been agglomerated either directly by compression or by addition of a binder in a proportion not exceeding 3 % by weight. Such briquettes are in the form of cubiform, polyhedral or cylindrical units with the minimum cross-sectional dimension greater than 25 mm.

3. For the purposes of subheading 4407 13, ‘S-P-F’ refers to wood sourced from mixed stands of spruce, pine and fir where the proportion of each species varies and is unknown.

4. For the purposes of subheading 4407 14, ‘Hem-fir’ refers to wood sourced from mixed stands of Western hemlock and fir where the proportion of each species varies and is unknown.

- the humidity index is determined in accordance with ISO 4470-81 (GOST 16588-91) and (or) national standards, as well as certified and other methods (methods) of measurements that meet the requirements of the legislation of the member states of the Eurasian Economic Union in the field of ensuring uniformity of measurements;

the thickness is determined in millimeters at any place of the length of the timber, but not closer than 150 mm from the end;

The width is defined in millimeters:

in trimmed with parallel edges - in any place of the length of the timber, where there is no obsol, but not closer than 150 mm from the end;

in uncircumcised, unilaterally trimmed - in the middle of the length of the timber as a half-sum of the widths of both strata (excluding bark and club), and fractions up to 5 mm are not taken into account, fractions of 5 mm or more are considered for 10 mm;

in trimmed with non-parallel edges - in the middle of the length of the timber on a formation that does not contain obsol.
