Particle board of wood, whether or not agglomerated with resins or other organic binding substances, surface-covered with melamine-impregnated paper (excl. oriented strand board and waferboard, fibreboard and cellular wood panels)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 4410 4 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

4410 Particle board, oriented strand board (OSB) and similar board (for example, waferboard) of wood or other ligneous materials, whether or not impregnated with resins or other organic binding substances: – Of wood: 4410 11 – – Particle board 4410 12 – – Oriented strand board (OSB) 4410 19 – – Other 4410 90 – Other

Particle board is a flat product of different length, width and thickness, made by pressing or extrusion. Slabs are usually made from wood chips or shavings obtained by mechanical grinding of round timber or wood waste. They can also be made from other wood materials.

such as particles obtained from bagasse, bamboo, cereal straw or flax or hemp shives. Particle board is agglomerated by the addition of an organic binder, usually a thermosetting resin, amounting to not more than 15% of the weight of the board. The chips, particles or other elements forming the particle board of this heading can easily be distinguished at the edges of the board with the naked eye. However, in some cases microscopic examination may be required to distinguish the particles and other elements from the ligno-cellulosic fibres forming the fibreboard of heading 4411. The heading also covers: (1) Oriented strand board, made of layers of thin wood strands the length of which is at least 2 times their width. The strands are mixed with binders (usually water-resistant), such as isocyanate or phenolic resins, and laid in layers forming a thick mat in which, to give the board its elastic-mechanical properties, the strands in the surface layers are usually oriented lengthwise and those in the inner layers are oriented crosswise or laid randomly. The mat is subjected to heat and pressure to produce a solid, uniform, strong structural board. (2) Waferboard, made of thin wood wafers the length of which is less than 2 times their width. The wafers are mixed with binders (usually water-resistant), such as isocyanate or phenolic resins, and laid randomly, thus forming a thick mat. The mat is subjected to heat and pressure to produce a solid, uniform structural board of high strength and water resistance. Particle board of this heading is usually sanded. Moreover, it may be impregnated with one or more substances not required for the agglomeration of the materials forming the board but giving it additional properties, for example, impermeability to water, resistance to rot or insect attack, resistance to ignition or the spread of fire, resistance to chemical agents or electric current, increased density. In the latter case the quantity of impregnating substances is considerably increased. Extruded boards may have internal channels running along their entire length. The heading also covers laminated wood panels consisting of: (1) a particle board faced on one or both sides with fibreboard; (2) several particle boards, whether or not faced on one or both sides with fibreboard; (3) several particle boards and several fibreboards assembled in any order. Goods of this heading are classified here whether or not they have been worked to obtain the profiles of goods of heading 4409; they may be curved, corrugated, perforated, cut or formed to shapes other than square or rectangular, and are classified here whether or not their surface, edges or ends have been worked, faced or coated (for example, with textile material, plastics, paint, paper or metal) or subjected to any

other operation, provided that these operations do not give them the essential character of articles of other headings. The heading does not cover: (a) plates or strips or tape of plastics containing wood flour as a filler (Chapter 39); (b) veneered particle board and similar board (for example, oriented strand board and waferboard), whether or not they have internal channels running along their full length (heading 4412); (c) cellular wood panels faced on both sides with particle board (heading 4418); (d) board of ligneous materials agglomerated with cement, plaster or other mineral binding substances (heading 6808). The heading further excludes goods having the character of articles or parts of articles more specifically described in other headings, whether or not obtained directly by pressing, extrusion or moulding or by other processes.

2. In this chapter, the term “pressed wood” means wood that has undergone chemical or physical treatment (when the layers are joined together, the treatment must be greater than necessary for simple bonding of the layers), resulting in increased density or hardness together with improved mechanical strength or resistance to chemical or electrical effects.

3. Headings 4414 to 4421 cover articles of the corresponding description of chipboards or similar boards, fibreboards, layered or pressed wood, similar to wood products.

4. The articles of heading 4410, 4411 or 4412 may be given the profile characteristic of the articles of heading 4409 and may be curved, corrugated, perforated, cut or shaped in a different shape than square or rectangular, or subjected to any other treatment, provided that this does not give them the properties of the articles of other headings.

5. Heading 4417 does not include tools whose blade, working edge, working surface or other working part is made of any of the materials listed in note 1 to Chapter 82.

6. Subject to the provisions of Note 1 above, and unless the context otherwise requires, the term “wood” in the headings of this Chapter also applies to bamboo and other woody materials.

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheading 4401 31, the expression ‘wood pellets’ means by-products, such as cutter shavings, sawdust or chips, of the mechanical wood-processing industry, furniture-making industry or other wood-transformation activities, which have been agglomerated either directly by compression or by the addition of a binder in a proportion not exceeding 3 % by weight. Such pellets are cylindrical, with a diameter not exceeding 25 mm and a length not exceeding 100 mm.

2. For the purposes of subheading 4401 32, the expression ‘wood briquettes’ means by-products such as cutter shavings, sawdust or chips, of the mechanical wood processing industry, furniture making or other wood transformation activities, which have been agglomerated either directly by compression or by addition of a binder in a proportion not exceeding 3 % by weight. Such briquettes are in the form of cubiform, polyhedral or cylindrical units with the minimum cross-sectional dimension greater than 25 mm.

3. For the purposes of subheading 4407 13, ‘S-P-F’ refers to wood sourced from mixed stands of spruce, pine and fir where the proportion of each species varies and is unknown.

4. For the purposes of subheading 4407 14, ‘Hem-fir’ refers to wood sourced from mixed stands of Western hemlock and fir where the proportion of each species varies and is unknown.
