5408 22 — Woven fabrics of yarn containing >= 85% artificial filament by weight, incl. monofilament of >= 67 decitex and a maximum diameter of <= 1 mm, dyed (excl. those of high-tenacity viscose yarn)

Woven fabrics of yarn containing >= 85% artificial filament by weight, incl. monofilament of >= 67 decitex and a maximum diameter of <= 1 mm, dyed (excl. those of high-tenacity viscose yarn)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 5408 2 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

This heading covers fabrics (as defined in point (I) (B) of the general provisions of Section XI) made of artificial knives or of monofilaments or flat threads of heading 5405; it includes a very wide range of dressing fabrics, lining fabrics, dressing materials, decorative fabrics, tent fabrics, parachute fabrics, etc. This heading does not include: (a) dressings impregnated or coated with pharmaceutical substances or packaged for retail sale (heading 3005); (b) fabrics of artificial monofilaments, any cross-sectional size of which exceeds 1 mm, or of flat or similar threads with apparent widths greater than 5 mm, of artificial textile materials (heading 4601); (c) fabrics of artificial fibers (heading 5516); (d) fabrics corded for tyres of heading 5902; (d) for technical purposes of heading 5911.

Notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. Throughout the nomenclature, the term ‘man-made fibres’ means staple fibres and filaments of organic polymers produced by manufacturing processes, either:

(a) by polymerisation of organic monomers to produce polymers such as polyamides, polyesters, polyolefins or polyurethanes, or by chemical modification of polymers produced by this process (for example, poly(vinyl alcohol) prepared by the hydrolysis of poly(vinyl acetate)); or

(b) by dissolution or chemical treatment of natural organic polymers (for example, cellulose) to produce polymers such as cuprammonium rayon (cupro) or viscose rayon, or by chemical modification of natural organic polymers (for example, cellulose, casein and other proteins, or alginic acid), to produce polymers such as cellulose acetate or alginates. The terms ‘synthetic’ and ‘artificial’, used in relation to fibres, mean: synthetic: fibres as defined at (a); artificial: fibres as defined at (b). Strip and the like of heading 5404 or 5405 are not considered to be man-made fibres. The terms ‘man-made’, ‘synthetic’ and ‘artificial’ shall have the same meanings when used in relation to ‘textile materials’.

2. Headings 5402 and 5403 do not apply to synthetic or artificial filament tow of Chapter 55.
