5801 33 — Cut weft pile fabrics, of man-made fibres (excl. terry towelling and similar woven terry fabrics, tufted textile fabrics and narrow woven fabrics of heading 5806)
Cut weft pile fabrics, of man-made fibres (excl. terry towelling and similar woven terry fabrics, tufted textile fabrics and narrow woven fabrics of heading 5806)
Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

(A) WHITE Tissues, other than those of commodity position 5802 The pile fabrics consist of at least three types of threads: the strained substrate and duck forming the soil fabric and the substrate or duck forming the pile. This pile consists of bundles or hinges on all or part of the surface; usually the pile is only on one side, but sometimes on both sides of the fabric. Fabrics with the main pile (velvet, plush, moquet, etc.) can be obtained by lifting the pile base on the rods introduced in the direction of the duck. Loops formed in this way are cut in the process of weaving or subsequently, sometimes they are left without cutting in the manufacture of fabrics with loop or uncut pile. Loops or bundles of cut pile are fixed with duck threads. The fabrics with the main pile are also produced in a way in which two canvases are produced face to face with a common pile base; then they are separated by cutting and two canvases of cloth with a cut pile are obtained. Fabrics with a fine cut pile (half-archate, cord cord velvet and others) have a pile usually of wet threads, which alternately rotate under the base, and then come to the surface above two or more main threads. After weaving, parts of these threads on the surface are cut and the cropped ends are raised to form a pile. A similar result is obtained by the introduction of paral bars on a relay basis, the duck pile is cut in the process of weaving. The piles are thus fixed in place by the main threads. Fabrics with duck pile, in which the pile-forming threads have not yet been cut, so that at this stage they do not have a standing pile, are classified in this heading (see note 2 to this chapter).
(B) CHENILLE FABRICS Chenille fabrics closely resemble the chenille carpets of heading 5702; like them, the pile (usually on both sides) is formed by chenille yarn. They are usually produced by means of an extra weft of chenille yarn or by introducing chenille of various lengths and colours into the warp during the weaving of the ground fabric. Pile and chenille fabrics are made of various materials, but silk, wool, fine animal hair, cotton and man-made fibres are the most frequently used for the pile. All these fabrics may be plain, ribbed or figured, or embossed after weaving; figured pile fabrics may have a surface only partly covered with pile, or a surface with partly cut and partly looped pile (figured velvet), which permits an extremely wide variety of designs. Pile fabrics imitating furskins (e.g., astrakhan, caracul or imitation leopard skin) are also classified in this heading, but artificial fur made, for example, by sewing or gluing on pile is excluded from this heading (heading 4304). It should be noted that many fabrics of this heading are made in the same way as the carpets of heading 5702; however, they can readily be distinguished from carpets since they are mainly used as furnishing or clothing fabrics rather than as floor coverings, being made of finer materials and with a much more flexible ground fabric. The heading excludes: (a) bouclé fabrics, ratinés and other fabrics which resemble pile fabrics in appearance but which are made from special yarns (bouclé yarns) or obtained by treatment (raising or napping) of ordinary fabrics (mainly Chapters 50 – 55); (b) terry towelling and similar terry fabrics and tufted textile fabrics (heading 5802); (c) pile, etc., fabrics falling within the definition of "narrow fabrics" (heading 5806); (d) knitted or crocheted fabrics or stitch-bonded materials with cut or looped pile (heading 6001 or 5602, as the case may be); (e) pile, etc., fabrics made as described in Part (II) of the General Explanatory Note to Section XI. Subheading Explanatory Note. Subheadings 5801 22 and 5801 32 In subheadings 5801 22 and 5801 32, the following illustrations of a cross-section of the fabric across the warp threads are to be used to distinguish cut corduroy from other weft cut-pile fabrics: Cut corduroy: Weft

1. This chapter does not apply to textile fabrics referred to in note 1 to Chapter 59, impregnated, coated, covered or laminated, or to other goods of Chapter 59.
2. Heading 5801 also includes woven weft pile fabrics which have not yet had the floats cut, at which stage they have no pile standing up.
3. For the purposes of heading 5803, ‘gauze’ means a fabric with a warp composed wholly or in part of standing or ground threads and crossing or doup threads which cross the standing or ground threads making a half turn, a complete turn or more to form loops through which weft threads pass.
4. Heading 5804 does not apply to knotted net fabrics of twine, cordage or rope, of heading 5608.
5. For the purposes of heading 5806, the expression ‘narrow woven fabrics’ means:
(a) woven fabrics of a width not exceeding 30 cm, whether woven as such or cut from wider pieces, provided with selvedges (woven, gummed or otherwise made) on both edges;
(b) tubular woven fabrics of a flattened width not exceeding 30 cm; and
(c) bias binding with folded edges, of a width when unfolded not exceeding 30 cm. Narrow woven fabrics with woven fringes are to be classified in heading 5808.
6. In heading 5810, the expression ‘embroidery’ means, inter alia, embroidery with metal or glass thread on a visible ground of textile fabric, and sewn appliqué work of sequins, beads or ornamental motifs of textile or other materials. The heading does not apply to needlework tapestry (heading 5805).
