6702 Flowers, leaves and fruits artificial and parts thereof; articles of artificial flowers, leaves or fruits: 6702 10 of plastic 6702 90 of other materials

This heading includes: (1) Artificial flowers, leaves and fruits resembling natural products made by bonding various parts (weaving, bonding, assembly or similar methods). This category also includes ordinary images of flowers, leaves or fruits obtained using artificial flower technology, etc. (2) Parts of artificial flowers, leaves or fruits (for example, pestiles, stamens, ovaries, petals, cups, leaves and stems). (3) Articles made of artificial flowers, leaves or fruits (for example, bouquets, garlands, wreaths, plants) and other articles used for decoration or decorative purposes and made by fastening artificial flowers, leaves or fruits.

This heading covers artificial flowers, foliage or fruit fitted with pins or other small attachment devices. The articles of this heading are used mainly for decorative purposes (e.g., in homes or churches) or as trimmings for hats, clothing, etc. Subject to the exclusions listed below, these articles may be made of textile materials, felt or fur felt, paper, plastics, rubber, leather, metal foil, feathers, shells or other materials of animal origin (e.g., artificial foliage made from the limbs of marine animals such as hydrozoa and bryozoa, specially treated and dyed), etc. Provided they satisfy the requirements set out in the preceding paragraphs, all such articles fall in this heading irrespective of the degree of completion of the finishing or working processes. The heading excludes: (a) cut flowers and foliage of heading 0603 or 0604 (e.g., dyed, silvered or gilded); (b) lace, embroidery or other textile fabrics with floral designs which, although they may be used as trimmings for clothing, are made by a process other than that used for artificial flowers (i.e., assembling the various parts (petals, stamens, stems, etc.) by binding with wire, textile material, paper, rubber, etc., or by gluing, or by similar methods) (Section XI); (c) headgear of artificial flowers or foliage (Chapter 65); (d) glassware (Chapter 70); (e) artificial flowers, foliage or fruit of ceramics, stone, metal, wood, etc., in one piece obtained by casting, forging, carving, stamping or other process, or consisting of parts assembled by a method other than binding, gluing, fitting together or similar methods; (f) wire, merely cut to length and covered with textile material, paper, etc., for making stems of artificial flowers, etc. (Section XV); (g) articles clearly identifiable as toys or carnival articles (Chapter 95).

1. This chapter does not cover:

(a) filtering or straining cloth of human hair (heading 5911);

(b) floral motifs of lace, of embroidery or other textile fabric (Section XI);

(c) footwear (Chapter 64);

(d) headgear or hairnets (Chapter 65);

(e) toys, sports requisites or carnival articles (Chapter 95); or

(f) feather dusters, powder puffs or hair sieves (Chapter 96).

2. Heading 6701 does not cover:

(a) articles in which feathers or down constitute only filling or padding (for example, bedding of heading 9404);

(b) articles of apparel or clothing accessories in which feathers or down constitute no more than mere trimming or padding; or

(c) artificial flowers or foliage or parts thereof or made-up articles of heading 6702.

3. Heading 6702 does not cover:

(a) articles of glass (Chapter 70); or

(b) artificial flowers, foliage or fruit of pottery, stone, metal, wood or other materials, obtained in one piece by moulding, forging, carving, stamping or other process, or consisting of parts assembled otherwise than by binding, glueing, fitting into one another or similar methods.
