Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 7106 3 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

7106 Silver (including silver with galvanic coating of gold or platinum), unprocessed or semi-processed, or in powder form: 7106 10 – powder – other: 7106 91 – in raw form 7106 92 – in semi-processed form

This heading covers various unwrought, semi-manufactured or powder forms of silver or its alloys (as defined in the General Explanatory Note to this Chapter), silver electroplated with gold (silver-gilt) or silver electroplated with platinum. However, this heading does not cover silver clad with precious metal. Silver is a white metal which does not corrode under atmospheric influences but tends to tarnish; it is the best conductor of heat and electricity, and also the most malleable and ductile metal after gold. In the pure state it is a very soft metal which readily alloys with other metals. Unalloyed silver is widely used in electrical appliances (contacts, fuses, etc.), in certain apparatus used in the chemical or food industries or in surgery, and also as a metal for electroplating. In accordance with the provisions of Note 5 to this Chapter (see the General Explanatory Note above), this heading covers the following silver alloys: (1) Silver-copper alloys. The most important of these are used in the manufacture of coins and also in goldsmiths' or silversmiths' wares; some are also used in the manufacture of electrical contacts. (2) Silver-copper-cadmium, silver-copper-titanium and silver-indium alloys, used in the manufacture of goldsmiths' or silversmiths' wares. (3) Silver-copper-zinc alloys, sometimes also containing cadmium, tin or phosphorus, used as solders. (4) Silver-antimony-tin-lead, silver-copper-lead, silver-cadmium and silver-thallium antifriction alloys. (5) Sintered silver-tungsten, silver-molybdenum, silver-nickel and silver-iron alloys, used in electrical contacts. This heading covers silver and its alloys in the following forms: (I) Powder, usually finely divided, obtained by mechanical or chemical processes. It is used in metallurgy and in the manufacture of metallising preparations for use in electronics and of conductive pastes. This heading excludes powders or flakes prepared as colouring matter (e.g., mixed with other colouring matter or presented as a liquid or paste dispersion in a binder or solvent); these fall in heading 3206, 32 07 (liquid lustres and similar preparations used in the ceramic and glass industries), 3208 – 3210, 3212 or 3213. (II) Unwrought silver in the form of lumps, grains, ingots, cast bars, granules, etc.; and also native silver in the form of lumps, pieces, crystals, etc., separated from the gangue. (III) Rods, profiles, wire, plates, sheets and strip. These are usually produced by rolling or drawing; strip, discs, etc., may also be obtained by cutting sheet silver. This heading covers silver thread used in the textile industry, provided it has not been gimped or otherwise combined with textile yarn (Section XI). High-quality sterile silver wire used for surgical sutures, however, falls in heading 3006. This heading also covers carbon-based metal-graphite blocks, plates, rods, etc., containing silver (see the Explanatory Note to heading 3801).

(IV) Pipes and tubes (including coil tubes) provided that they are not made in the form of specific articles (e.g. parts of chemical apparatus). (V) Foil (for silver), obtained by the habit of flattening or beating with a hammer thin sheets of silver separated by thin gaskets similar to those of gold-biting gold leaf. Such foil is usually available in the form of booklets and can be attached to a paper or polymer base, etc. However, this heading does not include embossing foil (also known as a “foil book”) consisting of silver powder agglomerated with gelatin, glue or other binder in a still, or of silver deposited on paper, plastic or other basis (heading 3212). (VI) Galoons, glitters and clippings. "" Galoons are loosely twisted silver wire used in embroidery and decoration. Shines and cutouts are used for similar purposes and are small pieces that are given a certain geometric shape (round, star-shaped, etc.) and which are usually pierced in the middle. This heading does not include cast, sintered, stamped, pressed edibles, etc., made in the form of blanks for jewelry, etc., described in subgroup III (for example, frames, blanks for rings, icons, flowers and figurines).

(b) from precious metals or metals clad with precious metals.

2. (A) Headings 7113, 7114 and 7115 do not include articles in which the precious metal or metal clad with the precious metal is present only as minor components, such as fine fittings or minor finishes (e.g. monograms, rims and edgings), and the provisions of point (b) of note 1 do not apply to these articles.

(B) Heading 7116 does not include articles containing precious metals or metals clad in precious metals (other than small constituent parts).

3. This group does not include:

(a) amalgams of precious metals or precious metals in the colloidal state (heading 2843);

(b) sterile surgical suture materials, dental filling materials or other products of Chapter 30;

(c) goods of Chapter 32 (e.g. glossy);

However, this does not apply to metals clad with precious metals, base metals or non-metals coated with precious metals by a galvanic method.

7. Throughout the Nomenclature, the term “precious metal clad metal” means a material made from a metal, on one or more surfaces of which a coating of precious metal is coated by soldering, welding, hot rolling or similar mechanical means. Unless otherwise specified in the context, the term also means a base metal inlaid with a precious metal.

8. Subject to the provisions of Note 1(A) to Section VI, goods corresponding to the description of heading 7112 shall be classified in that heading and in no other heading of the Nomenclature.

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheadings 7106 10, 7108 11, 7110 11, 7110 21, 7110 31 and 7110 41, the expressions ‘powder’ and ‘in powder form’ mean products of which 90 % or more by weight passes through a sieve having a mesh aperture of 0,5 mm.

2. Notwithstanding the provisions of chapter note 4(B), for the purposes of subheadings 7110 11 and 7110 19, the expression ‘platinum’ does not include iridium, osmium, palladium, rhodium or ruthenium.

3. For the classification of alloys in the subheadings of heading 7110, each alloy is to be classified with that metal, platinum, palladium, rhodium, iridium, osmium or ruthenium which predominates by weight over each other of these metals.
