8432 29 50 — Rotovators for use in agriculture, horticulture and forestry
Rotovators for use in agriculture, horticulture and forestry
Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

This heading covers machines, irrespective of the type of traction, used instead of hand tools for the following types of agricultural, horticultural or forestry work: (I) Preparation of soil for the cultivation of cultivated plants (clearing of land, raising virgin land, cultivation, plowing, loosening, etc.).
(II) Spreading or applying fertilizers, including manure or other organic matter, to improve the physicochemical properties of the soil. (iii) Planting or sowing. (IV) Soil treatment or care during the growing season (cultivation, weeding, seedling thinning, etc.). Machinery included in this heading may be towed by an animal goy or a vehicle (e.g. a tractor) or mounted on a vehicle (e.g. a tractor or a horse-drawn chassis). (In this context, the term tractor also refers to a single-axle tractor.) Trailer or hinged machines, which are replaceable equipment for the tractor. Some agricultural, horticultural or forestry machinery (e.g., plows and harrows) are intended solely for connection to a tractor by means of a connecting device (whether or not having a lifting mechanism). Other machines (e.g. milling cultivators) are powered by a general purpose tractor power take-off shaft. Such machines are hung and replaced in the field, in the forest or in the yard of farms. All these machines fall under this heading even if they are supplied with a tractor (whether or not they are mounted on a tractor). The tractor itself is classified in heading 8701. The same principle of classification applies to cases where another tractor is used instead of a tractor (e.g., one of those of heading 8704) or where a milling cultivator is mounted instead of wheels on the leading axis of a single-axle tractor, so that it acts both as a working organ and as a driving wheel that carries the whole unit. Self-propelled agricultural, garden or forestry machines. In these machines, the chassis and the working machine form a single inseparable unit (for example, motorized plows). Such machines are included in this heading. However, this heading does not include fertilisers based on motor vehicles which, together with other special vehicles, are classified in heading 8705. Smaller agricultural machinery which a person pulls or rolls by hand (e.g. plows, harrows, cultivators, hoes, skating rinks and seeders) are also included in this heading. The numerous machines of this heading include (1) Plows for all types of soil treatment, for example, bolt plows (with one or not how many lemechs or revolving plows of smooth plowing), soil deepeners (usually dumpless), and disc plows. (2) Arrows which are mainly used for grinding the soil after plowing. In dental harrows, teeth are mounted on a rigid, hinged or mesh frame, and sometimes on a drum or shafts. In disc harrows, the teeth are replaced by one or more rows of concave discs with cutting edges. (3) Flowers, cultivators, poultry and hoes, which are used for tilling the soil, destroying weeds or leveling the soil after plowing or in the process of growing crops. These machines usually have a horizontal frame with various working tools placed on it in several rows.
(shares, discs, tines, etc.), which may be rigidly or spring-mounted in a fixed position or movable, and may be interchangeable. (4) Seeders, planters and transplanters for seeds, bulbs, roots, seedlings, etc. They have a box, hopper or other container, sometimes mounted on wheels, and are equipped with sowing or planting mechanisms and usually with a coulter and a covering device. This category includes seeders, planters and transplanters used in no-till (conservation) farming systems for sowing cereals without ploughing the soil. They deliver a metered quantity of seed into the unprepared soil through the upper humus layer and plant residues, by making a narrow slot or hole in the soil and placing the seeds at a definite location and at a set depth. (5) Spreaders and distributors of organic and inorganic fertilisers. Spreaders of organic or solid inorganic fertilisers (mineral substances, compost, etc.), sometimes mounted on wheels, usually consist of containers fitted with a distributing mechanism, e.g., sliding bottom plates, a screw feeder, endless chains or centrifugal discs; portable mechanical appliances used for the same purposes are also included in this heading. Inorganic fertiliser distributors spread synthetic fertilisers or other solid synthetic substances evenly over the surface of the soil. Organic fertiliser spreaders distribute over the field organic fertilisers (compost) or nutrients obtained by processing livestock waste. Trailers with a movable floor and a shredding-spreading device enabling them, during unloading, to work as spreaders of solid and slurry fertilisers, comprising a wheeled container usually fitted with spreading plates or paddles, fall in heading 8716. Portable injectors for introducing liquids into the soil are also classified in this heading. They have a long hollow rod through which the fertiliser is pumped into the soil. (6) Machines for clearing land of scrub, undergrowth, stalks of harvested crops, roots, etc. They usually have two large-diameter wheels and a drum fitted with cutting blades. (7) Stone-pickers, resembling harrows but with two rows of curved tines converging on an open grid box for collecting the stones. (8) Rollers, used mainly for firming the soil. These include smooth, ribbed, ring-type, compacting, etc., rollers. This heading also includes rollers for gardens, lawns, sports grounds, grass paths, etc. (9) Thinners (e.g., beet bunchers), used for thinning out seedlings. These machines may be very complex and may have photoelectronic control devices. (10) Machines for topping the haulm or stalks of plants with excessive growth PARTS Subject to the general provisions regarding the classification of parts (see the General Explanatory Note to Section XVI), this heading covers parts of the above machines. These include, inter alia:
plough beams, skimmers, ploughshares, mouldboards, coulters (including shares and discs with diamond cutting edges, etc.); tools and tines (rigid or spring) for scarifiers, cultivators or weeders; tines, drums and discs for harrows; smooth rolls, discs and components for rollers; distributing mechanisms for fertiliser distributors, seeders, planters or transplanters; shares, tines, discs and other tools for mechanical hoes. This heading excludes: (a) hand-operated dibbers, planters, transplanting devices and similar hand tools (heading 8201); (b) liquid elevators and pumps for liquids (including pumps mounted on the wheels of agricultural machines for spraying, etc.) (heading 8413); (c) mechanical appliances for agricultural, horticultural or forestry use (whether or not hand-operated) for projecting or spraying liquids or powders (heading 8424); (d) manure loaders and other loaders for agricultural, horticultural or forestry use (heading 8428); (e) bucket loaders and road rollers, self-propelled (heading 8429); (f) excavating, levelling, boring or extracting machinery and road rollers, not self-propelled (heading 8430); (g) stump pullers and tree transplanters (heading 8436); (h) agricultural trailers and vehicles (Chapter 87).

In subheadings 8427 20 190 1, 8427 90 000 1 and 8436 80 100 1, the date of manufacture shall be determined on the basis of the technical documentation of the manufacturer (technical passport, instruction manual) and the manufacturer's plate, which shall be fixed in a conspicuous, easily accessible place of the machinery and shall not be replaced during operation. If the manufacturer's technical documentation and the manufacturer's plate contain conflicting information about the date of manufacture or there is no information about the manufacturer of the equipment on the date of manufacture, then this technique is considered a technique, since the release of which more than 3 years have passed.
If the manufacturer's information indicates only the year of manufacture, then the date of manufacture of the equipment is considered 1 July of the year of manufacture; if the month and year of manufacture are indicated, the date of manufacture is the 15th day of the month specified in the manufacturer's information.
