8437 80 — Machinery used in the milling industry or for the working of cereals or dried leguminous vegetables (excl. farm-type machinery, heat treatment equipment, centrifugal dryers, air filters and machines for cleaning, sorting or grading seed, grain or dried leguminous vegetables)

Machinery used in the milling industry or for the working of cereals or dried leguminous vegetables (excl. farm-type machinery, heat treatment equipment, centrifugal dryers, air filters and machines for cleaning, sorting or grading seed, grain or dried leguminous vegetables)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 8437 5 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

8437 Machinery for the purification, sorting or calibration of seeds, grains or dry legumes; fencing for the milling industry or for the processing of cereals or dry legumes, other than equipment used on agricultural farms: 8437 10 – machines for the cleaning, sorting or calibration of seeds, grains or dry legumes 8437 80 – equipment other 8437 90 – parts

(i) Machines for cleaning, cropping or calibration of seeds, grains or dry legumes This heading includes machinery for agricultural, horticultural or industrial applications used for the cleaning, sorting or calibration of cereals, dry legumes, seeds, etc., under the influence of processes of brewing, purging, roaring, etc. Such machines include: (1) Fans consisting of a feed tray, blower and rumble a (usually of vibration type). (2) Flowers, rotating fanboards and separators for seeds or grains, more complex machines that clean by airflow and sort seeds or grain according to weight, p azmer or shape. Some seed separators, etc., have additional devices designed to coat seeds with insecticidal powders, etc.

(3) Belt-type screens, often used for cleaning beet seed. These devices consist of a series of rollers by means of which an endless inclined conveyor belt is driven beneath a feed hopper. The seeds roll freely to the lower part of the belt, but the lighter ones adhere to the velvety surface of the belt. (4) Special machines for selecting and grading seeds intended for sowing. This heading also covers machines used in the flour-milling industry, designed for cleaning, sorting or grading grain before milling. The operating principle of some of these machines is the same as that of the winnowers, sorting installations or machines for separating and sorting mentioned above; however, they have a greater output and are specially adapted for use in the flour-milling industry, e.g.: (1) Cyclone separators for cleaning grain. (2) Machines for cleaning and grading by means of rotating perforated drums or indented (pocket) drums. (3) Separators with a suction fan and with vibrating-type sieves (vibrating screens). (4) Separators and graders of the magnetic or electromagnetic type. (5) Washing machines, stoners and "whizzers", with or without additional drying columns. (6) Grain cleaners. (7) Machines for moistening grain, whether or not incorporating heating or weighing equipment. This heading also covers combined machines which simultaneously clean, sort and grade, including machines fitted with devices for electromagnetic separation. (II) MACHINERY FOR THE FLOUR-MILLING INDUSTRY In addition to machinery for cleaning, sorting or grading grain before milling (see Part (I) above), the following machines are included in the heading as being used in the flour-milling industry: (A) Machines for blending or conditioning grain for milling, namely: (1) Grain blenders in pre-set proportions. (2) Scouring machines consisting of drums with spikes and rubber-covered cylinders rotating in the opposite direction, thus removing softened grains. However, this heading excludes: (a) equipment operating on the principle of a change of temperature (heading 8419). For example, drying or cooling columns fall in heading 8419, but machines with heating equipment which moisten grain are included in this heading; (b) centrifugal driers (heading 8421); (c) conveyors and elevators (e.g., of the bucket type, belt type or pneumatic conveyors) (heading 8428). (B) Equipment used for crushing or grinding, namely: (1) Grinding machines.

(2) Roller crushers, or roller mills, consisting of several sets of fluted rolls, sometimes cooled, which grind grain into semolina, durum wheat semolina and flour. (3) Reducing machines, or roller mills with smoother rolls for grinding semolina, durum wheat semolina, etc., into flour. (4) Disintegrators, or impact crushers, used for reducing to flour the milling products obtained by grinding or crushing in the preceding processes, e.g., meal, etc. (5) Feeders – machines specially designed to ensure an uninterrupted supply of an even flow of grain to the roller crusher. This heading excludes small mills used on farms (heading 8436). (C) Machines for sorting or separating flour from middlings or semolina. This category includes machines designed for separating flour, meal, semolina, middlings and other milling products. This separation is carried out by a series of operations performed on machines of the following types, which are often used in combination with one another: (1) Sifting machines (sifters) for separating flour from groats and meal. Centrifugals (or reels), consisting of a drum inside which there is a beater, covered on the outside with meshes of different sizes. Vibrating sifters or plansifters, consisting of sets of freely oscillating sieves arranged one above the other, and collecting trays. (2) Sifting machines, or purifiers. In these devices, by means of vibrating sieves and a current of air blown through them, semolina, etc., is graded and the bran is blown off. (3) Beater machines for bran finishing. (4) Mixing machines for flour, bran, etc., and machines for enriching flour with vitamins. However, this heading excludes: (a) flour driers (heading 8419); (b) air filters and cyclones used for extracting dust from the exhaust-fan stream coming from sorting or sifting machines (heading 8421); (c) flour-yield recorders and other measuring or checking instruments for flour of Chapter 90. (III) MACHINERY USED FOR WORKING CEREALS OR DRIED LEGUMINOUS VEGETABLES The working carried out by the machines considered here is usually preceded by preliminary cleaning, sorting or grading (see Part (I) above). This category includes: (1) Hulling machines for cereals or dried leguminous vegetables. (2) Husking or polishing machines for rice. (3) Shelling machines for dried peas, lentils or beans.

(4) Grain-flaking machines for producing oat flakes, etc., whether or not with additional heating devices. (5) Special grinding machines for milling cereals (other than bread grain, see Part (II) (B) above) or dried leguminous vegetables into flour. (6) Awners and scourers, designed for removing the awns or sharp tips from grains of oats or barley. This part of the heading excludes: (a) machines or plant operating on the heat-exchange principle (e.g., steamers, driers or roasters for producing puffed or toasted grain; malting apparatus and plant for roasting flour, etc.) (heading 8419); (b) machines for processing following the flour-production stage (e.g., bread-baking, preserving or macaroni-making) (heading 8438). PARTS Subject to the general provisions regarding the classification of parts (see the General Explanatory Note to Section XVI), parts of the goods of this heading are also classified in this heading, e.g.: sieves and sieve frames for the flour-milling industry (other than bolting cloth, made up or not – heading 5911); mixing or separating drums; rolls for grinding machines or reducing machines, etc. However, this heading excludes millstones (heading 6804).
