Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

This heading covers the machines specified in the heading text which work by changing the shape of metal or of metal carbide.

Typically, such machines are mechanically driven, but similar machines with manual or foot drive are also classified in this heading. These latter can be distinguished from the hand tools of heading 8205 and from the hand tools of heading 8467 in that they are generally designed to be fitted on the floor, workbench, wall or other machine and are therefore supplied with a support plate, mounting frame, stanina, etc. This heading includes: (1) Forging and stamping machines. In a broad sense, forging refers to all processes of processing heated metal by impact or pressure, either to remove pudling slag (cracking) or to mold metal. Except in cases of compression, in which the metal is processed into the form of balls, the metal to be forged has either the form of blanks, for example, blooms, blanks or strips, or the form of ducks and rods, usually round section. More precisely, forging can be defined as an operation that uses heating but does not use stamps. Stamping (or cutting) is a process in which metal is forced by impact or pressure to fill cavities in metallic forms called stamps. This operation is performed hot for hard metals (in particular steel) or cold for soft metals. Usually a press is used. In the process of stamping or cutting, the stamps completely cover the workpiece. In some cases, however, a stamp is used that affects only part of the workpiece being processed. Then the tool is a stamp in its pure form, and the operation is called stamping. Stamping machines can give burrs that occur when stamping or cutting. This cleaning operation is carried out with the help of special trimming stamps. Finish operations performed on a precision stamp are called processing to a precisely specified size. This processing gives the exact given dimensions. The following are examples of machines specially designed and built to perform the operations described above: – hammers, falling hammers (mechanical, hydraulic or pneumatic and steam hammers) operating in a series of short sharp blows; – metalworking presses operating under continuous pressure. However, general purpose presses not specially designed for the processing of metals are not included in this heading (heading 8479). (2) Flexible machines. This includes machines for processing flat products (sheets, plates and strips), which, passing products through three or four sets of rolls, give them a cylindrical bending (for this rollers are installed in parallel, as on a pipe-forming machine) or a conical shape (the rollers are not parallel); machines for processing non-flat products (rods, corners, shaped and special profiles, pipes). These machines work either with the help of forming rolls, by bending under the press, or for pipes (and, in particular, for oil pipelines) - by pulling their ends, while the main section is held by a fixed cylinder. (3) Short-flex machines. These include: (a) machines for processing flat products. The flexibility of a flat product consists in giving the sheet (or strip) a residual deformation with a small radius in a straight line without breaking the metal. This operation is performed either on a universal edge-flex machine, or on a edge-flex press;

(b) Machines for working non-flat products. Bending of bars, rods, tubes, angles, shaped and special sections is very similar to the bending referred to in paragraph (2) above; bending of wire consists of giving it a curvature in one plane. Wire bending machines performing more complex operations (e.g., spring coiling machines) are not simple bending machines and fall in heading 8463. (4) Straightening machines. These machines are designed to correct defects in non-flat products, e.g., wire, bars, rods, tubes, angles, shaped and special sections, or in flat products, e.g., strip or sheets, arising from handling after manufacture. Straightening machines include, for example: (a) roller straightening machines, which consist of a series of parallel rollers (or cylinders) either of relatively large diameter and high rigidity but few in number (5 – 11), or of small diameter and high flexibility but many in number (usually 15 – 23), with an equal number of counter-rollers; (b) stretch straightening benches, which correct defects by a small permanent elongation. (5) Mechanical shears. The cutting process requires two cutting tools whose edges lie in the same plane, facing vertically towards the metal being cut. These tools penetrate the metal, which undergoes plastic deformation and whose fibres, under ever higher pressure and ever deeper penetration, break along the line of the blades. Machines of this type include: counterweight shears, lever shears and guillotine shears, which use blades; circular shears, which instead of blades use tools in the form of discs or sections of truncated cones. (6) Punching machines used for perforating, notching or blanking metal by means of two tools, one of which enters the other. The piercing tool is called the punch and the other the die. The metal is broken as with shears, and the shape of the hole obtained depends on the shape of the tools. Machines of this type also include machines for making gear wheels by blanking. (7) Nibbling machines are small machines for cutting sections of various cross-sections (L-, T-, I- or U-sections) and half-round sections, either to prepare them for assembly (making grooves, slots, tenons, dovetail profiles) or simply for cutting or punching holes. (8) Extrusion presses for forming bars, rods, wire, angles, shaped and special sections, tubes, etc. These presses are designed to force a mass of metal through a die by means of a ram. This operation is carried out hot or cold depending on the ductility of the metal. (9) Presses for forming articles from metal powders by sintering. (10) Presses for baling scrap metal. PARTS AND ACCESSORIES Subject to the general provisions regarding the classification of parts (see the General Explanatory Note to Section XVI), parts and accessories (other than tools of Chapter 82) of the machines of this heading fall in heading 8466.

The heading also excludes: (a) Hand tools (heading 8205). (b) Machining centres, unit construction machines (single station) and multi-station transfer machines, for working metal (heading 8457). (c) Tools for working in the hand, pneumatic, hydraulic or with self-contained electric or non-electric motor (heading 8467). (d) Addressing plate embossing machines (heading 8472). (e) Cast-iron breakers and special stamping mills for breaking up cast-iron scrap into pieces (heading 8479). (f) Bending, folding and straightening machines for working the leads of semiconductor devices (heading 8486). (g) Testing machines and appliances (heading 9024). Subheading Explanatory Notes. Subheadings 8462 21, 8462 31 and 8462 41 See the Explanatory Notes to subheadings 8458 11 and 8458 91.

1. For the purposes of subheading 8465 20, the term ‘machining centres’ applies only to machine-tools for working wood, cork, bone, hard rubber, hard plastics or similar hard materials, which can carry out different types of machining operations by automatic tool change from a magazine or the like in conformity with a machining programme.

In subheadings 8427 20 190 1, 8427 90 000 1 and 8436 80 100 1, the date of manufacture shall be determined on the basis of the technical documentation of the manufacturer (technical passport, instruction manual) and the manufacturer's plate, which shall be fixed in a conspicuous, easily accessible place of the machinery and shall not be replaced during operation. If the manufacturer's technical documentation and the manufacturer's plate contain conflicting information about the date of manufacture or there is no information about the manufacturer of the equipment on the date of manufacture, then this technique is considered a technique, since the release of which more than 3 years have passed.

If the manufacturer's information indicates only the year of manufacture, then the date of manufacture of the equipment is considered 1 July of the year of manufacture; if the month and year of manufacture are indicated, the date of manufacture is the 15th day of the month specified in the manufacturer's information.
