1. For the purposes of this Chapter, the expression “unmanned aircraft” means any aircraft other than those referred to in heading 8801 designed to fly without a pilot on board. Such vehicles may be designed to carry payloads or equipped with stationary digital cameras or other equipment to enable them to perform utilitarian functions during flight.

The expression “unmanned aircraft”, however, does not include flying toys intended solely for entertainment (heading 9503).

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheadings 8802 11 to 8802 40, the expression ‘unladen weight’ means the weight of the machine in normal flying order, excluding the weight of the crew and of fuel and equipment other than permanently fitted items of equipment.

2. For the purposes of subheadings 8806 21 to 8806 24 and 8806 91 to 8806 94, the expression ‘maximum take-off weight’ means the maximum weight of the machine in normal flying order, at take-off, including the weight of payload, equipment and fuel.

1. For the purpose of subheading 8802 40 00, the term “maximum take-off mass” means the corresponding mass specified by the manufacturer in the flight manual of the aircraft.

2. For the purposes of positions 8802 30 000 3, 8802 40 00, the term “cargo ramp” means a device forming part of the structure of the aircraft connecting the interior space of the aircraft and the surface of the ground with an accessible slope for the transport (entry/exit) of goods into and out of the interior space of the aircraft.

3. In heading 8802:

(a) the term wide-body aircraft means aircraft having a maximum outer width of the fuselage (excluding protruding parts, for example for landing gear) of at least 5 m;

(б) термин «самолеты дальнемагистральные» означает самолеты, способные без дополнительных топливных баков, с максимальной предусмотренной нагрузкой и без дозаправки, совершать беспосадочные полеты на расстояние не менее 8000 км для пассажирских самолетов и на расстояние не менее 6000 км для грузовых самолетов;

(c) the term "two aisles between rows of seats" means that the cabin in which the largest number of seats is accommodated has two through aisles from the beginning to the end of the cabin.
