9013 80 — Liquid crystal devices, n.e.s. and other optical appliances and instruments not elsewhere specified in chapter 90

Liquid crystal devices, n.e.s. and other optical appliances and instruments not elsewhere specified in chapter 90

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 9013 4 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

9013 Liquid crystal devices not constituting articles provided for more specifically in other headings; lasers, other than laser diodes; other optical appliances and instruments, not specified or included elsewhere in this Chapter: 9013 10 – telescopic sights for fitting to arms; periscopes; telescopes designed to form parts of machines, appliances, instruments or apparatus of this Chapter or Section XVI 9013 20 – lasers, other than laser diodes 9013 80 – other devices, appliances and instruments 9013 90 – parts and accessories

In accordance with Note 5 to this Chapter, optical measuring or checking instruments, appliances and machines are excluded from this heading and fall in heading 9031. Nevertheless, in accordance with Note 4 to this Chapter, certain reflecting telescopes fall in this heading rather than in heading 9005. Moreover, it should be noted that optical instruments and appliances may fall not only in headings 9001 to 9012 but also in other headings of this Chapter (in particular heading 9015, 9018 or 9027). This heading covers: (1) Liquid crystal devices consisting of a layer of liquid crystal sandwiched between two sheets or plates of glass or plastics, whether or not fitted with electrical connections, presented in the piece or cut to special shapes, and not constituting articles described more specifically in other headings of the Nomenclature. (2) Lasers. These emit or amplify electromagnetic radiation in the wavelength range from 1 nm to 1 mm (ultraviolet, visible light and infrared regions of the spectrum) by the process of controlled stimulated emission. When the medium generating coherent optical radiation (e.g., crystals, gases, liquids, chemical products) is excited by light from an electrical source or by a reaction from another energy source, the light rays arising within the generating medium are repeatedly reflected and amplified so that a coherent light beam (visible or invisible) is emitted from one end, which is partially transparent. In addition to the generating medium, the energy source (pumping system) and the optical resonator (reflecting system), i.e., the basic elements combined in the laser head (possibly with Fabry-Perot interferometers, interference filters and spectroscopes), lasers usually also contain certain auxiliary components (e.g., a power supply unit, a cooling system, a control unit and, in the case of a gas laser, a gas supply system, or, in the case of liquid lasers, a container fitted with a pump for dye solutions). Some of these auxiliary components may be contained in the same housing as the laser head (compact laser), or may take the form of separate units connected to the laser head by cables, etc. (laser system). In the latter case these units fall in this heading provided they are presented together. Lasers fall in this heading not only when they are intended for incorporation in machines or appliances, but also when they can be used independently as compact lasers or laser systems for

various purposes, such as research, teaching or laboratory work, e.g., laser pointers. However, this heading excludes lasers which have been adapted to perform quite specific functions by the addition of supplementary equipment consisting of special devices (e.g., work tables, work holders, means for feeding and positioning the workpieces, means for observing and checking the progress of the work, etc.), and which are therefore identifiable as machine-tools, medical apparatus, control apparatus, measuring apparatus, etc. Machines and appliances incorporating lasers are also excluded from this heading. If their classification is not specified in the Nomenclature, they are to be classified with the machines or appliances having a similar function. Examples: (i) machine-tools for working any material by removal of material by laser (e.g., metal, glass, ceramics or plastics) (heading 8456); (ii) machines and apparatus for laser soldering, brazing or welding, whether or not capable of cutting operations (heading 8515); (iii) instruments for aligning pipes by means of a laser beam (heading 9015); (iv) laser apparatus specially used for medical purposes (e.g., in ophthalmic surgery) (heading 9018). Subject to the provisions of Notes 1 and 2 to this Chapter, parts and accessories of lasers, e.g., laser tubes, also fall in this heading. However, this heading excludes electric flash lamps used for pumping, such as xenon lamps, iodine lamps, mercury vapour lamps (heading 8539), laser diodes (heading 8541) and laser crystals (e.g., rubies), laser mirrors and lenses (heading 9001 or 9002). (3) Hand magnifying glasses and magnifiers (e.g., of the pocket type or for office use) and thread counters (these magnifiers may be fitted with or combined with a lighting bulb; they fall in this heading if the bulb improves the use of the magnifier); binocular magnifiers (usually on stands) which, unlike the stereoscopic microscopes of heading 9011, are fitted with eyepieces but have no objective. (4) "Door eyes" for looking through a door; also similar articles fitted with an optical system. (5) Telescopic sights for fitting to arms, lens or mirror type, presented separately; optical devices suitable for use with arms and mounted on them, or presented with the firearms on which they are to be mounted, are classified with the arms, see Note 1 (d) to Chapter 93. (6) Telescopes designed to form parts of instruments of other headings of this Chapter (e.g., telescopes forming parts of surveying instruments) or of machines of Section XVI. (7) Fibrescopes for industrial use. Fibrescopes for medical purposes (endoscopes) are excluded (heading 9018). (8) Stereoscopes, including hand-operated stereoscopes, for three-dimensional viewing of colour photographic transparencies, consisting of a plastic housing containing two fixed lenses and a lever-operated rotating mechanism (for changing the pictures, which are mounted in sets on each of the interchangeable rotating discs). (9) Kaleidoscopes, other than toy kaleidoscopes (Chapter 95).

(10) Magnifying periscopes for submarines or tanks; and non-magnifying periscopes (e.g., for trenches). (11) Framed glass mirrors, optically worked, which are not suitable for fitting in instruments or apparatus (e.g., certain rear-view mirrors, those for inspecting chimneys or drains, and special mirrors for observation in wind tunnels). Rear-view mirrors or other mirrors not optically worked (including shaving mirrors, whether or not magnifying) are excluded (heading 7009 or 8306). (12) Optical signalling apparatus using light beams, designed for transmitting optical signals over long distances (e.g., by Morse code). (13) Transparency viewers fitted with a single magnifying lens and used for examining photographic transparencies. PARTS AND ACCESSORIES Subject to the provisions of Notes 1 and 2 to this Chapter (see the General Explanatory Note), parts and accessories of the apparatus or appliances of this heading are also classified in this heading.
