9102 99 — Pocket-watches and the like, incl. stop-watches, with hand or automatic winding (excl. of precious metal or of metal clad with precious metal)

Pocket-watches and the like, incl. stop-watches, with hand or automatic winding (excl. of precious metal or of metal clad with precious metal)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Machine translation. The original is the Russian text of the EAEU tariff, and customs goes by it; this translation is for understanding only and has no legal force.

9102 Wrist watches, pocket watches and other watches intended to be carried on or with oneself, including stopwatches, other than watches and stopwatches of heading 9101: – wrist watches operated by electricity, having or not having a built-in stopwatch: 9102 11 – only with mechanical indication 9102 12 – only with optical-electronic indication

9102 19 - Other wristwatches, other watches, having or not having a built-in stopwatch: 9102 21 - with automatic winding 9102 29 - - Other - Other: 9102 91 - - - - - Electrically powered 9102 99 - Other

This heading covers mechanical and electromechanical (mostly electronic) time-measuring instruments with a case and a movement, designed to be worn or carried on the person and to operate in any position, which indicate the time of day or measure intervals of time, irrespective of the thickness of the movement. They include wrist-watches, pocket-watches, fob-watches, ladies' handbag or men's bag watches, watches mounted in brooches, rings, etc. However, time-keeping devices mounted on a base, even a simple one, are not to be regarded as wrist-watches or pocket-watches. The heading covers not only watches with simple movements but also watches with complications (i.e., incorporating additional features other than those needed simply to indicate hours, minutes and seconds), e.g., chronographs, alarm watches, repeater and striking watches, automatic watches, calendar watches and watches indicating the power reserve. The heading covers fancy watches or those with special features, such as waterproof, shock-proof or anti-magnetic watches; eight-day watches; self-winding watches; watches with luminous dials and hands; watches with centre seconds hands or special dials; watches without hands; sports watches (e.g., pearl divers' watches with a built-in depth indicator); Braille watches. Chronometers are high-precision watches tested in various positions and at different temperatures. This Chapter also covers deck watches, but not marine or similar chronometers (heading 9105). Chronographs not only show the time of day but can also be used to measure relatively short intervals of time. Chronographs with hands have two special hands in addition to the usual three hands (for hours, minutes and seconds), namely a centre seconds hand which makes one complete revolution per minute and can be started, stopped and returned to zero by means of a push-button or crown, and a hand which records how many minutes the centre seconds hand has been running. Some chronographs have yet another additional seconds hand. The heading also covers stop-watches. Where they have hands, they differ from the chronographs mentioned above in that they do not have the usual hour, minute and seconds hands but only a centre seconds hand (with or without an additional seconds hand) and a minute-recording hand. However, electronic stop-watches often have an auxiliary device for indicating the time of day.

Chronographs and stopwatches can show fifth, tenth, hundredth and thousandths of a second. They are sometimes equipped with special devices so that the speed of the runner, car, sound, etc., pulse rate, machine performance, etc. can be determined without calculations. Some may also have time recording devices. Watch straps presented with watches (attached or not) are classified in this heading. This heading does not cover the following articles when presented separately: watch cases intended to be worn or carried by oneself and parts thereof (heading 9111), watch movements for watches intended to be worn or carried by oneself (heading 9108 or 9110), straps, tapes and bracelets for watches intended to be worn or carried by oneself (heading 9113), and parts of watch movements (usually heading 9110 or 9114). This heading also excludes: (a) pedometers (heading 9029); (b) watches not intended to be worn or carried with watches for watches intended to be worn or carried with oneself (heading 9103); (c) watches fitted on dashboards and similar watches for ground vehicles, aircraft, spacecraft or ships (heading 9104).

Notes to chapter 91 — Clocks and watches and parts thereof 4 items

Notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. This chapter does not cover:

(a) clock or watch glasses or weights (classified according to their constituent material);

(b) watch chains (heading 7113 or 7117, as the case may be);

(c) parts of general use defined in note 2 to Section XV, of base metal (Section XV), or similar goods of plastics (Chapter 39) or of precious metal or metal clad with precious metal (generally heading 7115); clock or watch springs are, however, to be classified as clock or watch parts (heading 9114);

(d) bearing balls (heading 7326 or 8482, as the case may be);

(e) articles of heading 8412 constructed to work without an escapement;

(f) ball bearings (heading 8482); or

(g) articles of Chapter 85, not yet assembled together or with other components into watch or clock movements or into articles suitable for use solely or principally as parts of such movements (Chapter 85).

2. Heading 9101 covers only watches with case wholly of precious metal or of metal clad with precious metal, or of the same materials combined with natural or cultured pearls, or precious or semi-precious stones (natural, synthetic or reconstructed) of headings 7101 to 7104. Watches with case of base metal inlaid with precious metal fall in heading 9102.

3. For the purposes of this chapter, the expression ‘watch movements’ means devices regulated by a balance-wheel and hairspring, quartz crystal or any other system capable of determining intervals of time, with a display or a system to which a mechanical display can be incorporated. Such watch movements shall not exceed 12 mm in thickness and 50 mm in width, length or diameter.

4. Except as provided in note 1, movements and other parts suitable for use both in clocks or watches and in other articles (for example, precision instruments) are to be classified in this chapter.
