Olive oil and its fractions, whether or not refined, but not chemically modified: extra virgin olive oil

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Duty rate
5%

This is the base rate. A tariff quota, a preference for the country of origin and a tariff exemption lower it; anti-dumping and special duties are paid on top of it

Supplementary unit
Not applicable
Requirements and measures
2

None: russian bans and restrictions, dual use, EAEU non-tariff regulation, trade defence measures — duty on top of the tariff, tariff quota.

Whether a measure applies to your goods depends on their characteristics and the shipping documents

VAT
22% or 10%

10% if the product matches the line of List No. 908: “Масло оливковое и его фракции, нерафинированные или рафинированные, но без изменения…”. Otherwise 22%.

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

1509 Olive oil and its fractions, unrefined or refined, but without changing chemical composition: 1509 10 – olive oil of the first (cold) pressing 1509 90 – other

Olive oil is obtained from the fruit of the olive tree (Olea europaea L.). This heading covers: (A) Olive oil of the first (cold) pressing, which is obtained from the fruit of the olive tree exclusively mechanical or other physical media (for example, pressing) under conditions, in particular thermal, not leading to spoilage of the oil. The only treatments allowed are washing, decanting, centrifugation or filtration. First (cold) pressed olive oil includes: (1) First (cold) pressed olive oil suitable for consumption in its natural state. It is transparent, color from light yellow to green, with a specific smell and taste. (2) Purified olive oil, or having no taste or smell, or containing free fatty acids (in terms of oleic acid) in an amount of more than 3.3 g per 100 g, or characterized by certain properties simultaneously. It can be used as such for technical purposes or, after refining, for human consumption. (B) Refined ol willow oil, which is obtained from the oil of the first (cold) pressing (see paragraph (A) above) by various refining methods that do not lead to changes in the initial glyceride structure or other changes in the structure of the constituent fatty acids. Refined olive oil is a light transparent oil without precipitation and with a content of free fatty acids (in terms of oleic acid) not more than 0.3 g per 100 g. It is yellow in color, without a characteristic smell or taste and is suitable for eating in its pure form or in a mixture with oil of the first (cold) pressing. (B) The fractions and mixtures of oils described in (A) and (B) above. The first (cold) pressed olive oil discussed in point (A) can be distinguished from the oils discussed in points (B) and (B) in accordance with standard 33-1981 of the Codex Alimentarius. The olive oil of this heading can be distinguished from the olive oil of heading 1510 by the negative reaction of the bellier. In some cases, the presence of residual olive oil can only be established by examining triterpene diols in the unsaponified fraction.

This heading does not include residual olive oil and mixtures thereof with olive oil (heading 1510) or re-esterified oil derived from an olive oil (heading 1516).

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheading 1509 30, virgin olive oil has a free acidity expressed as oleic acid not exceeding 2,0 g/ 100 g and can be distinguished from the other virgin olive oil categories according to the characteristics indicated in the Codex Alimentarius Standard 33-1981.

2. For the purposes of subheadings 1514 11 and 1514 19, the expression ‘low-erucic-acid rape or colza oil’ means the fixed oil which has an erucic acid content of less than 2 % by weight.
