2302 Bran, sowing, mons and other residues from sieving, milling or other methods of processing grains of cereals or legumes, ungrained or granular: 2302 10 – corn 2302 30 – wheat 2302 40 – other cereals 2302 50 – legumes

This heading covers: (A) Bran, sharps, middlings and other residues from the milling of cereals. This category includes mainly by-products from the milling of wheat, rye, barley, oats, maize, rice, grain sorghum or buckwheat, which do not satisfy the requirements of Note 2 (A) to Chapter 11 regarding starch content and ash content. They include, in particular: (1) bran, consisting of the outer husk of the cereal grain with a small proportion of adhering endosperm and a little flour; (2) sharps, middlings (or dunst), obtained from ground cereal grain as a by-product of flour manufacture and consisting mainly of finer particles of husk remaining after sieving and sorting, and a little flour. (B) Residues of sifting or other working of cereal grains. Residues from the sifting of grain before milling consist mainly of: – grains of the main cereal, small, misshapen, crushed or broken; – seeds of various foreign plants mixed with the main grain; – fragments of leaves, stalks, mineral matter, etc. The category also includes: (1) residues from the cleaning of grain silos, ships' holds, etc., which are of broadly the same composition as those mentioned above; (2) the pericarp (fruit coat) removed from rice grain during polishing; (3) residues resulting from hulling, rolling, flaking, pearling, slicing or kibbling of cereal grains. (C) Similar residues and waste from the grinding or other working of leguminous plants.

This heading also includes the listings of the above products in the granules (see the general provisions to this chapter). This heading also includes corn cobs which have been ground whole together with or without sheet wrap, and which do not meet the requirements for small collapse and ash content provided for in note 2(A) to Chapter 11 for products obtained by grinding maize. Grain chaff obtained after threshing is classified in heading 1213. This heading does not cover cake or other solid residues obtained from the extraction of vegetable fats or oils (headings 2304 to 2306).

- "potential alcohol concentration by weight" - the number of kilograms of pure alcohol, which can be obtained with complete fermentation of sugars contained in 100 kg of the product,

"total alcohol concentration by weight" - the sum of actual and potential alcohol concentrations by weight,

- "wt.%" - alcohol concentration by mass.

4. For the purposes of subheadings 2309 10 110 0 to 2309 10 700 0 and 2309 90 310 0 to 2309 90 700 0, the term “dairy products” means products falling in headings 0401, 0402, 0404, 0405, 0406 and in subheadings 0403 20 110 0 to 0403 20 390 0, 0403 90 110 0 to 0403 90 690 0, 1702 11 000 0, 1702 19 000 0 and 2106 90 520 0.

5. Subheading 2309 90 200 0 includes only residues from the production of starch from maize and does not include mixtures of these residues with products obtained from other plants or products obtained from maize by other means than wet production of starch containing:

- maize sowings used in the washing process in a ratio not exceeding 15 wt.%, and/or

Residues of water for soaking corn in the washing process, including residues of soaking water used to produce alcohol or other starch-derived products.

These products may also contain residues obtained by extracting oil from corn germs during the wet grinding process.

The possible starch content in them does not exceed 28 wt.% in terms of dry product, the fat content does not exceed 4.5 wt.% in terms of dry product and the protein content does not exceed 40 wt.% in terms of dry product.
