Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 8705 4 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

8705 Special purpose motor vehicles (e.g. emergency trucks, cranes, fire trucks, concrete mixers, road cleaners, washing machines, car repair shops, X-ray machines) other than those used for the carriage of passengers or goods (+): 8705 10 – cranes 8705 20 – drilling vehicles 8705 30 – fire trucks 8705 40 – concrete mixers 8705 90 – other Motor vehicles specially designed or adapted for the transport of various devices which are not intended for the transport of goods or for the purpose of transport of certain goods.

This heading includes: (1) Emergency trucks, which are car chassis with or without a floor and equipped with lifting devices such as non-reversible cranes, goats, blocks or winches, and designed to lift and tow vehicles in emergency condition. (2) Pumping vehicles equipped with a pump, usually powered by a motor vehicle (e.g. fire trucks). (3) Trucks equipped with ladders or lifting platforms for the repair of contact hanging networks, street lighting, etc.; trucks with adjustable boom and platform ("crane") for filming or television equipment. (4) Trucks used for cleaning streets, sewage ditches, airfield runways, etc. (e.g. sweeping, watering and combined sweeping and washing cars, sewage cars). (5) Snow purifiers are plow and rotary with built-in equipment; that is, cars designed exclusively for snow removal and usually equipped with turbines, rotating blades, etc., with drive either from the car engine or from a separate engine. In all cases, interchangeable plow or rotary snow blowers of all types are not included in this heading (heading 8430), whether or not they are mounted on a motor vehicle. (6) Trucks-distributors of all kinds, equipped with heating equipment or not, as well as equipment for the distribution of tar or gravel, for agricultural purposes, etc. (7) Cranes, not intended for the carriage of goods, consisting of an automobile chassis on which the cab and the rotary crane are permanently mounted. However, trucks with self-loading devices are not classified in this heading (heading 8704). (8) Truck drilling (i.e. trucks equipped with a tower assembled with a crane, winches and other drilling devices, etc.). (9) Trucks equipped with stack-layers (i.e., a movable platform on a vertical base, which, as a rule, is driven by the engine of the car). However, this heading does not include self-loading motor vehicles equipped with winches, lifting devices, etc., but intended mainly for the carriage of goods (heading 8704). (10) Concrete mixers consisting of a cab and an automobile chassis on which a concrete mixer adapted both for the manufacture and transportation of concrete is permanently mounted. (11) Mobile electric generator units consisting of a truck on which an electric generator unit is mounted, with a drive either from the car engine or from a separate engine. (12) Cars with radiological installations (e.g. equipped with a medical office, a darkened room and a full set of radiological equipment).

(13) Mobile clinics (medical or dental) with an operating theatre, anaesthetising equipment and other surgical apparatus. (14) Searchlight lorries, having a searchlight mounted on the vehicle, the power usually being supplied by a generator driven by the engine of the motor vehicle. (15) Vans for outside radio broadcasting. (16) Telegraph, radio-telegraph or radio-telephone vans, receiving and transmitting; mobile radar installations. (17) Racecourse vans equipped with calculating machines for the automatic totalling of winnings on races. (18) Mobile laboratories (e.g., for checking the performance of agricultural machinery). (19) Test lorries with recording instruments for determining the tractive effort of the motor vehicles towing them. (20) Mobile bakeries, fully equipped (dough kneader, oven, etc.); field kitchens. (21) Workshop vehicles equipped with various machine-tools and hand tools, welding appliances, etc. (22) Mobile banks, mobile libraries and mobile showrooms for the display of goods. The heading also excludes: (a) self-propelled road rollers (heading 8429); (b) agricultural rollers (heading 8432); (c) small mobile appliances, pedestrian-controlled and equipped with an auxiliary motor (e.g., appliances for sweeping parks, squares, etc., and appliances for applying road markings) (heading 8479); (d) vehicles equipped for habitation (heading 8703). MOTOR VEHICLE CHASSIS OR LORRIES WITH WORKING EQUIPMENT It should be noted that, to fall in this heading, a vehicle fitted with lifting or handling equipment, levelling, excavating or boring equipment, etc., must in fact constitute an essentially complete motor vehicle chassis or lorry, i.e., it must comprise at least the following mechanical features: propelling engine, gear box and controls for gear-changing, and steering and braking facilities. On the other hand, self-propelled machines (e.g., cranes, excavators) in which one or more of the propelling or central control elements listed above are located in the cab of the working machine mounted on a wheeled or tracked chassis, whether or not the machine as a whole is capable of moving on the road under its own power, are classified, for example, in heading 8426, 8429 or 8430. Similarly, this heading excludes self-propelled wheeled machines in which the chassis and the working equipment are specially adapted to each other and form an integral mechanical unit (e.g., self-propelled motor graders). In this case the equipment is not simply mounted on a motor vehicle chassis, but is completely integrated with it; the chassis cannot be used for other purposes and may have the essential characteristics of a motor vehicle indicated above.

It should be noted, however, that self-propelled snow-ploughs or snow-clearing vehicles with built-in equipment are always classified in this heading. Subheading Explanatory Note. Subheading 8705 10 See the Explanatory Note to heading 8705, Item (7).

Notes to chapter 87 — Vehicles other than railway or tramway rolling stock, and parts and accessories thereof 15 items

Notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. This chapter does not cover railway or tramway rolling stock designed solely for running on rails.

2. For the purposes of this chapter, ‘tractors’ means vehicles constructed essentially for hauling or pushing another vehicle, appliance or load, whether or not they contain subsidiary provision for the transport, in connection with the main use of the tractor, of tools, seeds, fertilisers or other goods. Machines and working tools designed for fitting to tractors of heading 8701 as interchangeable equipment remain classified in their respective headings even if presented with the tractor, and whether or not mounted on it.

3. Motor chassis fitted with cabs fall in headings 8702 to 8704, and not in heading 8706.

4. Heading 8712 includes all children's bicycles. Other children's cycles fall in heading 9503.
