8802 11 00 — Other aircraft (for example, helicopters, aeroplanes), except unmanned aircraft of heading 8806; spacecraft (including satellites) and suborbital and spacecraft launch vehicles: helicopters: of an unladen weight not exceeding 2,000 kg

Helicopters: of an unladen weight not exceeding 2,000 kg

Full name

Other aircraft (for example, helicopters, aeroplanes), except unmanned aircraft of heading 8806; spacecraft (including satellites) and suborbital and spacecraft launch vehicles: helicopters: of an unladen weight not exceeding 2,000 kg

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

8802 Other aircraft (for example, helicopters, aeroplanes); spacecraft (including satellites) and suborbital and spacecraft launch vehicles: – helicopters: 8802 11 – – of an unladen weight not exceeding 2000 kg 8802 12 – – of an unladen weight exceeding 2000 kg 8802 20 – aeroplanes and other aircraft, of an unladen weight not exceeding 2000 kg 8802 30 – aeroplanes and other aircraft, of an unladen weight exceeding 2000 kg but not exceeding 15 000 kg 8802 40 – aeroplanes and other aircraft, of an unladen weight exceeding 15 000 kg 8802 60 – spacecraft (including satellites) and suborbital and spacecraft launch vehicles

This heading includes: (1) Aircraft heavier than air, equipped with a power plant. This category includes aircraft (aerodrome-based, seaplanes, amphibious aircraft), autogyros (equipped with one or more rotating rotors freely rotating around vertical axes) and helicopters (equipped with one or more rotating rotors driven by the engine).

Such aircraft may be used for military purposes, for the transport of persons or goods, or for training, aerial photography, agricultural work, rescue work, fire-fighting, or for meteorological or other scientific purposes. The heading covers aircraft radio-controlled from the ground or from another aircraft, and also aircraft of special design for use as land vehicles. (2) Spacecraft, being vehicles capable of travelling outside the earth's atmosphere (e.g., communications or weather satellites). (3) Spacecraft launch vehicles, designed to place payloads in earth orbit ("satellite launch vehicles") or on interplanetary trajectories ("spacecraft launch vehicles"). At the end of powered flight such launch vehicles impart to the payload a final velocity exceeding 7000 m/s. (4) Suborbital launch vehicles travel on parabolic trajectories and generally carry instruments for scientific and other technical purposes beyond the earth's atmosphere, whether or not the payload is recoverable. Where the payload is released, these vehicles do not reach a velocity exceeding 7000 m/s. The payload is often returned to Earth by parachute for re-use. The heading excludes, however, artillery rockets, guided missiles, e.g., "ballistic missiles", and similar munitions which do not impart to the payload a final velocity exceeding 7000 m/s (heading 9306). They carry warheads, e.g., with explosives, submunitions, chemical agents, and strike the target after a flight on a parabolic trajectory. The heading also excludes: (a) models, whether or not made exactly to scale, used, for example, for decorative purposes (e.g., heading 4420 or 8306) or solely for demonstration purposes (heading 9023); (b) toys or models for recreational purposes (heading 9503).

1. For the purposes of this Chapter, the expression “unmanned aircraft” means any aircraft other than those referred to in heading 8801 designed to fly without a pilot on board. Such vehicles may be designed to carry payloads or equipped with stationary digital cameras or other equipment to enable them to perform utilitarian functions during flight.

The expression “unmanned aircraft”, however, does not include flying toys intended solely for entertainment (heading 9503).

Subheading notes

English text as published in Annex I to Regulation (EU) 2021/1832 (Combined Nomenclature). The EAEU tariff and the EU nomenclature copy these notes from the same convention. For a Russian declaration the binding version is the Russian one: Annex to Decision No 80 of the EEC Council of 14 September 2021.

1. For the purposes of subheadings 8802 11 to 8802 40, the expression ‘unladen weight’ means the weight of the machine in normal flying order, excluding the weight of the crew and of fuel and equipment other than permanently fitted items of equipment.

2. For the purposes of subheadings 8806 21 to 8806 24 and 8806 91 to 8806 94, the expression ‘maximum take-off weight’ means the maximum weight of the machine in normal flying order, at take-off, including the weight of payload, equipment and fuel.

1. For the purpose of subheading 8802 40 00, the term “maximum take-off mass” means the corresponding mass specified by the manufacturer in the flight manual of the aircraft.

2. For the purposes of positions 8802 30 000 3, 8802 40 00, the term “cargo ramp” means a device forming part of the structure of the aircraft connecting the interior space of the aircraft and the surface of the ground with an accessible slope for the transport (entry/exit) of goods into and out of the interior space of the aircraft.

3. In heading 8802:

(a) the term wide-body aircraft means aircraft having a maximum outer width of the fuselage (excluding protruding parts, for example for landing gear) of at least 5 m;

(б) термин «самолеты дальнемагистральные» означает самолеты, способные без дополнительных топливных баков, с максимальной предусмотренной нагрузкой и без дозаправки, совершать беспосадочные полеты на расстояние не менее 8000 км для пассажирских самолетов и на расстояние не менее 6000 км для грузовых самолетов;

(c) the term "two aisles between rows of seats" means that the cabin in which the largest number of seats is accommodated has two through aisles from the beginning to the end of the cabin.
