9613 80 — Lighters (excl. gas fuelled pocket lighters, and fuses and primers for propellent powders and explosives)

Lighters (excl. gas fuelled pocket lighters, and fuses and primers for propellent powders and explosives)

Names come in English where the EU Combined Nomenclature publishes them — chapters, headings and subheadings, whose first six digits are the same Harmonized System; deeper EAEU detail is a machine translation, marked as such. Official texts — tariff notes, measures, lists and classification rulings — are the original: customs and your broker go by that wording. Where we show a machine translation of them, it is marked; where our quality check rejected one, the Russian stays.

Explanatory notes to heading 9613 3 paragraphs

Machine translation from Russian. The original is the EEC explanatory note, and that is what a classification dispute is argued from; the translation is for understanding and has no legal force.

9613 Cigarette lighters and other lighters, including mechanical or electric ones, and parts thereof, other than flints and wicks: 9613 10 – pocket gas lighters, not refillable 9613 20 – pocket gas lighters, refillable 9613 80 – other lighters 9613 90 – parts

This heading covers (1) Mechanical lighters. They give a spark, usually with a grooved rim wheel that rotates, making contact with a "silicon" (usually consisting of a ferrocerium alloy). (2) Electric lighters. Electrical current from the mains or battery gives a spark or, in some types of lighters, produces incandescence of an electric resistor. (3) Chemical lighters. In such lighters, the catalyst (usually of spongy platinum) is incandescent during the catalytic process in the presence of gas. (4) Non-mechanical lighters. Lighters of this type consist of a container with a fuel tank and a small replaceable metal bar with a steel end. When the steel end hits the "silicon" fixed outside the container, a spark arises, igniting the combustible material located near the end of the buck. Lighters in this heading may be pocket lighters or

table, or can be designed to be fixed on the wall, on a gas stove, etc. This heading also includes lighters for motor vehicles or other vehicles. Lighters presented in combination with other items (e.g. cigarette case, powder case, watch, usually with digital dial, electronic calculators) are classified according to the Basic Rules of Interpretation of the Nomenclature. This heading also includes identifiable parts of lighters (e.g. shells, grooved wheels, empty or full fuel tanks). This heading does not include fuses of heading 3603, flints (heading 3606), wicks (heading 5908 or 7019), or fuel in containers (ampoules, bottles, cans, etc.) used to fill or refill cigarette or similar lighters (usually heading 3606).
